SUBJECT:

Authorization to Execute a Declaration of Covenants and Restrictions on Real Property on San Bruno Mountain (Owner – Brookfield Northwest Ridge II, LLC)

RECOMMENDATION:

Adopt a resolution authorizing the President of the Board to execute a Declaration of Covenants and Restrictions on Real Property on San Bruno Mountain.

DISCUSSION:

The document presented for your review and execution by the President must be executed pursuant to the San Bruno Mountain Area HCP Agreement. A parcel located within the San Bruno Mountain HCP Area has recently been approved for development. The document presented to you will impose a set of covenants and restrictions on the property which will ensure a secure source of funding for the San Bruno Mountain Habitat Conservation Trust. Upon execution by the County, the document will be recorded against the subject properties.

FISCAL IMPACT:

None to the County. Provides for landowner payment into HCP Trust Fund.
