AN URGENCY ORDINANCE AMENDING SECTION 6565.7 OF CHAPTER 28.1 OF PART ONE OF DIVISION VI (ZONING REGULATIONS) OF THE SAN MATEO COUNTY ORDINANCE CODE REGARDING DESIGN REVIEW

 

The Board of Supervisors of the County of San Mateo, State of California, ORDAINS as follows

 

SECTION 1. Section 6565.7 of Chapter 28.1 of Part One of Division VI (Zoning Regulations) of the San Mateo County Ordinance Code is amended to read as follows:

 

Section 6567.7 Action on Application for Design Review

 

A.

Review or action on an application for Design Review shall be taken by the Design Review Committee for projects located in the following communities:

     
 

1.

Palomar Park.

 

2.

Devonshire.

     
 

In all other areas within the Design Review District, review or action shall be by the Design Review Administrator. For the Emerald Lake Hills and Oak Knoll manor communities (areas zoned RH/DR only), the Design Review Administrator will conduct a public hearing on an application for Design Review, as required by section 6565.8.A.

   

B.

When the project in question requires another permit or approval, such as (but not limited to) a use permit, variance or subdivision, to be acted upon by the Zoning Hearing Officer, Planning Commission or Board of Supervisors, then the action of the Design Review Committee or Design Review Administrator shall be in the form of a recommendation to the decision-maker on the other permit(s), who shall act upon the application for design review only after receiving and considering such recommendation. In such cases, the decision-maker may refer any revisions to the design of the project back to the Design Review Committee or Design Review Administrator for further recommendation prior to taking action on the project.

   

C.

The Design Review Committee or Design Review Administrator may refer any matter directly to the Planning Commission when, in their opinion, such action will be in the public interest.

   

D.

Action on an application for Design Review shall be to: (a) approve the application and plans as submitted, (b) approve them with modifications, or (c) disapprove the application and plans.

 

SECTION 2. The facts that support the adoption of this ordinance as an urgency measure for the immediate preservation of the public peace, health or safety are that the current design review committee for the Emerald Lake Hills and Oak Knoll Manor area is no longer able to be effective and must be immediately disbanded, and the transfer of authority to the Design Review Administrator as provided for by this ordinance must be accomplished immediately to ensure that the current schedule for consideration of design review applications for the area is not interrupted.

 

SECTION 3. This Ordinance shall be in full force and effect immediately upon its passage.
