RESOLUTION AUTHORIZING THE APPROVAL OF A FOURTH AMENDMENT TO THE AGREEMENT WITH HAGMAN ASSOCIATES ARCHITECTS FOR ARCHITECTURAL EXPENSES IN THE REHABILITATION OF THE SAFE HARBOR SHELTER

FOR THE TERM OF NOVEMBER 1, 2004 THROUGH JUNE 30, 2007, AND
AUTHORIZING THE DIRECTOR OF THE DEPARTMENT OF HOUSING OR THE DIRECTOR’S DESIGNEE TO EXECUTE SUBSEQUENT AMENDMENTS WHICH MODIFY THE COUNTY'S MAXIMUM FISCAL OBLIGATION BY NO MORE THAN $25,000 (IN AGGREGATE), AND/OR MODIFY THE CONTRACT TERM AND/OR SERVICES SO LONG AS THE MODIFIED TERM OR SERVICES IS/ARE WITHIN THE CURRENT OR REVISED FISCAL PROVISIONS.

 

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, pursuant to Government Code, Section 31000, County may contract with independent contractors for the furnishing of special services to or for County or any Department thereof; and

WHEREAS
, on November 9, 2004, pursuant to Resolution #067034, the County and Hagman Associates Architects (“the parties”) entered into an Agreement to provide $135,000 from CDBG funds for architectural services in the rehabilitation of the Safe Harbor Shelter located at 295 North Access Road in South San Francisco (“the Project”), for a contract term running from November 1, 2004, through June 30, 2006 (the “Agreement”); and

 

WHEREAS, on April 26, 2005, pursuant to Resolution #067267 the Agreement was amended whereby the County provided $42,000 of additional CDBG funds, for a total amount of $177,000, to accommodate additional project requirements including but not limited to, providing an accessible interior chair lift (“the First Amendment”); and


WHEREAS
, on October 18, 2005, pursuant to Resolution #067603 the Agreement was further amended whereby, the County provided $50,000 of additional CDBG funds, for a new total amount of $227,000, for the purpose of design and construction services to satisfy additional requirements set forth by the South San Francisco Fire Department and to resolve accessibility issues (“the Second Amendment”); and

WHEREAS
, on March 14, 2006, pursuant to Resolution #067854 the Agreement was further amended whereby the County provided another $175,000 to accommodate additional hard and soft costs (“the Third Amendment”). Resolution #067854 also authorized the extension of the Agreement through December 31, 2006; and

 

WHEREAS, there has been presented to this Board of Supervisors for its consideration and acceptance, a fourth amendment adding the amount of $65,000 to accommodate additional hard and soft costs related to the postponement of the commencement of construction, for a new contract total of $467,000 and extending the contract period through June 30, 2007 (the “Fourth Amendment”) reference to which is hereby made for further particulars, and the Board of Supervisors has examined and approved the same as to form and content and desires to enter into the same.

 

NOW, THEREFORE, IT IS HEREBY RESOLVED that the President of this Board of Supervisors be, and is hereby authorized and directed to execute said Fourth Amendment for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest the President’s signature thereto.

 

BE IT FURTHER RESOLVED, that the Director of the Department of Housing or the Director’s designee shall be authorized to execute subsequent amendments which modify the County's maximum fiscal obligation by no more than $25,000 (in aggregate), and/or modify the contract term and/or services so long as the modified term or services is/are within the current or revised fiscal provisions.
