Application to the Local Agency Formation Commission for the Annexation of a Portion of Guadalupe Canyon Parkway from the Corporate Limits of the City of Daly City to a Point Approximately Seven Hundred Feet (700’) Northeasterly of the Corporate Limits of Daly City to the City of Daly City

 

Recommendation

Adopt a resolution requesting the Local Agency Formation Commission (LAFCO) to take proceedings for the annexation of a portion of Guadalupe Canyon Parkway as described above to the City of Daly City.

The proposed annexation will result in the section of Guadalupe Canyon Parkway, where a U-turn pocket was constructed to allow safe turning movements for the parents/relatives/care givers that drop off or pick up children at the John F. Kennedy School, to be located entirely within the City of Daly City.

 

Background

 

Previous Board Action

1.

Authorized the President of the Board to execute an agreement with the City of Daly City, which provided that the County would finance 50% of the cost, not-to-exceed $50,000, for the construction of a U-Turn Pocket (Project) as described above. The agreement also provided that the City would accept the annexation of the portion of Guadalupe Canyon Parkway within the Project area.

Adopted a resolution approving zero tax exchanges pursuant to Section 99 et. seq. of the Revenue and Taxation Code for annexations of roadways where no property taxes are involved.

 

Discussion

The Project has been completed and the annexation of the section of Guadalupe Parkway within the Project area will complete the terms of the City/County Agreement previously described. This section of Guadalupe Canyon Parkway is currently not included in Daly City’s sphere of influence and therefore a minor amendment to Daly City’s sphere will be necessary in order to facilitate the proposed annexation.

 

Section 99 et. seq. of the Revenue and Taxation Code requires the entities involved in an annexation to present resolutions to LAFCO indicating their agreement to the exchange of property taxes associated with an annexation, prior to LAFCO taking any action on the annexation, even though no property taxes are involved. Your Board has previously adopted a “blanket" resolution agreeing to a zero tax exchange for annexations involving only roadway areas in order to “stream line” the process.

 

A resolution has been approved as to form by County Counsel.

 

Fiscal Impact

The County’s initial share of constructing the U-turn pocket will be offset by annual savings of $2,730 per year to the Road Fund based on 0.14 miles being annexed to the City and an average cost of $19,500 per mile per year to maintain the County road system.

 

There is no impact to the General Fund.
