Resolution Determining that the Resurfacing of County Maintained Roads in the MidCoast Area is an Allowed Exception as Provided by the General Policies of the Montara-Moss Beach-El Granada Community Plan

 

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, this Board adopted Resolution No. 58743 on October 11, 1994, which approved amendments to the Road Policies and Standards of the Montara-
Moss Beach-El Granada (MidCoast) Community Plan; and

 

WHEREAS, this Board adopted Ordinance No.03606 on October 11, 1994, which established policies related to road improvements in the MidCoast area of the County; and

 

WHEREAS, General Policy 1. of the amended MidCoast Community Plan provides that the level of improvement of public roads shall preserve the small town, semi-rural character of the Mid-Coast neighborhood and protect the natural environment; and

 

WHEREAS, only three (3) owner initiated road improvement projects have been constructed in the MidCoast since the revision to the MidCoast Community Plan was approved by this Board, as a State Constitutional amendment (Proposition 218) approved by the voters in 1996, essentially precludes the use of property owner assessments as a means of financing road improvements as provided for in the aforesaid resolution and ordinance adopted by this Board; and

 

WHEREAS, the Department of Public Works subsequently conferred with the MidCoast Community Council to develop alternative projects that did not require property owner assessments and surveyed property owners on twelve (12) roads in the MidCoast to determine if improvements that meet the standards in the MidCoast Community Plan were desired by said property owners; and

 

WHEREAS, property owners on nine (9) of the roads that were surveyed did not return the surveys, were not willing to commit to being responsible for work associated with their property, or were concerned that road improvements as provided by the MidCoast Community Plan would lead to more traffic on their street that would travel at a higher rate of speed; and

 

WHEREAS, the County roads in the MidCoast need to be maintained to meet the needs of the public that use these roads serve; and

 

WHEREAS, the State Controller generally considers road resurfacing as maintenance and not an improvement, and the Planning Division of Community Development also considers resurfacing as a maintenance type project and has, in the past, issued Coastal Development Permit Exemptions for this type of work; and

 

WHEREAS, the resurfacing of County maintained roads in the MidCoast will not eliminate the standards as approved in the Community Plan, but will allow the Department of Public Works more flexibility in maintaining MidCoast roads in a reasonable condition commensurate with the Community Plan.

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that:

The resurfacing (asphalt concrete overlays, cape seals, slurry seals and other resurfacing applications) of County maintained roads in the MidCoast area, is an allowed exception as provided by the General Policies of the MidCoast Community Plan, as the resurfacing of MidCoast roads will preserve the existing “neighborhood quality” of the area.

The Director of Public Works is hereby directed to coordinate any resurfacing work with drainage improvements that have previously been approved by this Board, and with other drainage improvements as may be recommended by the Committee that this Board created as part of the Local Coastal Plan update.
