Resolution Approving the Criteria for Garbage Collection Services That Will be Used to Develop Uniform Garbage Collection Franchises That are Proposed to be Negotiated by the South Bayside Waste Management Authority (SBWMA) on Behalf of its Member Agencies, Including the County, for Garbage Service Beginning in January 2011; and Directing the Director of Public Works to Contact and Advise Known Homeowners Associations or Advisory Agencies in Unincorporated Areas Within the SBWMA Service Area That Currently Do Not Receive Franchise Garbage Collection Service, of the Criteria That Will be Used to Define the Garbage Collection Services That Will Be Provided in Their Area and to Explain the Difference Between Franchised and
Non-Franchised Garbage Collection

 

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, this Board authorized the County to become a member of the SBWMA in 1982, which is comprised of 12 jurisdictions: Atherton, Belmont, Burlingame, East Palo Alto, Foster City, Hillsborough, Menlo Park, Redwood City, San Carlos, the City of San Mateo, the County of San Mateo, and the West Bay Sanitary District; and

 

WHEREAS, this Board authorized a franchise agreement with subsequent amendments with BFI, now Allied Waste (Allied), for garbage and recyclables collection services in the North Fair Oaks Area (County Service Area No. 8 – [CSA8]); and

 

WHEREAS, the SBWMA, in February 2006, initiated a five and one half (5-1/2) year contractor selection process on behalf or its member agencies that can result in new uniform franchises for solid waste, recyclables, and organic materials collection services (Collection Services) in each member agency’s area; and

 

WHEREAS, the SBWMA has recommended criteria for developing garbage Collection Services that will be provided in the member agencies’ respective areas through individual franchise agreements; and

 

    WHEREAS, the SBWMA has requested that each agency’s governing board approve the criteria for Collection Services that will be used to develop a uniform franchise agreement for each member agency; and

 

    WHEREAS, there are unincorporated areas within the SBWMA service area that receive Collection Services from non-franchised collectors; and

 

WHEREAS, the SBWMA has requested that the County consider if these areas will be included in a uniform franchise(s) for the unincorporated area; and

 

WHEREAS, the Director of Public Works has recommended that said areas be considered for franchise garbage collection, as these areas currently receive the same service as properties within adjacent cities, but are subject to unregulated garbage rates; and

 

WHEREAS, this Board has considered the recommendations of the SBWMA and the Director of Public Works and concurs in their recommendations.

 

    NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that:

 

1.

This Board hereby approves the criteria for garbage collection services as shown on Exhibit “A” attached hereto and made hereof, that will be used to develop garbage franchises as may be approved by this Board for garbage collection services within the unincorporated areas that are also within the SBWMA service area; and

 

2.

The Director of Public Works is authorized and directed to contact known homeowners associations or advisory agencies in unincorporated areas within the SBWMA service area that are not presently provided franchised garbage collection, to advise them of the criteria for providing garbage/recycling/organic material collections service in their area, and to explain the difference between franchised and non-franchised garbage collection.
