RESOLUTION A) WAIVING THE BID PROCESS; B) AUTHORIZING THE PURCHASING AGENT TO ENTER INTO A 60-MONTH COST PER REPORTABLE (CPR) AGREEMENT WITH OLYMPUS AMERICA, INC. FOR REAGENTS, CALIBRATORS, CONSUMABLES, AND SERVICE FOR HIGH VOLUME TESTS IN AN AMOUNT NOT TO EXCEED $634,976; C) AUTHORIZING THE PURCHASING AGENT TO ENTER INTO A 60-MONTH SUPPLIES AGREEMENT WITH OLYMPUS AMERICA, INC. FOR REAGENTS, CALIBRATORS, AND CONSUMABLES FOR LOW VOLUME TESTS IN AN AMOUNT NOT TO EXCEED $287,248; AND
D) AUTHORIZING THE PURCHASING AGENT TO AMEND EITHER AGREEMENT AS NEW REAGENTS BECOME AVAILABLE DUE TO NEW TECHNOLOGY

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, Ordinance Code Section 2.92.050 authorizes the Board of Supervisors to waive bid process in any situation where the Board of Supervisors determines that the best interest of the county could be served without the necessity of bids; and

 

WHEREAS, On December 14, 2004, your Board waived the Bid Process and approved the purchase of Chemistry Analyzers from Olympus America, Inc. The Choice was based on cost, specific needs of SMMC and the ability of the Olympus equipment to handle different types of specimen from serum, body fluid, and urine; and

 

WHEREAS, Because the analyzers are manufactured by Olympus, SMMC is required to use only reagents manufactured by Olympus, therefore SMMC is requesting a waiver of the bid process; and

 

WHEREAS, performing these tests in-house will give SMMC a cost savings of approximately $162,000 in FY2007 and $216,000 in 2008. The more specialized tests will still be provided by Quest Diagnostics; and

 

WHEREAS, The Cost Per Reportable (CPR) Agreement includes test materials such as reagents, calibrators, consumables, and service coverage on the equipment through the end of the 60-month CPR Agreement in an amount not to exceed $634,976. It is an agreement based on volume used, with a price commitment from Olympus and a volume commitment from of SMMC. SMMC must purchase stated monthly minimum amounts in order to maintain committed pricing; and

 

WHEREAS, The Supplies Agreement includes reagents, calibrators, and consumables for low volume tests, with no volume commitment, in an amount not to exceed $287,248; and

 

WHEREAS, The availability of reagents adapted to the Olympus analyzers can improve the turn-around time of test results, reduce the expenses by retaining testing in-house, and increase revenue from reimbursements. Therefore SMMC is requesting that your Board authorize the Purchasing Agent to amend either agreement as new reagents become available due to new technology; and

 
 

WHEREAS, this Board has determined that the best interest of the County would be served by waiving the Request for Proposals process; and

 
 

NOW THEREFORE, IT IS HEREBY RESOLVED that the bid process is hereby waived;

 

IT FURTHER HEREBY FURTHER RESOLVED, that the Purchasing Agent is hereby authorized to enter into the agreements with Olympus America, Inc. for reagents, calibrators and comsumables for high low volume tests and for high volume tests;

 

AND BE IT FURTHER RESOLVED, that the Purchasing Agent is authorized to amend either Agreement as new reagents become available due to new technology.
