Resolution Authorizing the President of the Board to Execute Amendments to Agreements with the Town of Woodside, and the City of Redwood City for Transmission of Sanitary Sewage, and for Sanitary Sewage Treatment Capacity Rights and Services for the Woodside Town Center Sewer Assessment District

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, acting as the Governing Board of the Fair Oaks Sewer Maintenance District (FOSMD), that

WHEREAS, the property at 3373 Woodside Road (APN 072-190-040) in the Town of Woodside has a failing septic system and presents a potential public health hazard; and

WHEREAS, the Woodside Town Council passed Resolution No. 2006-6567 which granted sewer allocations to said property, authorized its annexation to the Town Center Sewer Assessment District (TCSAD), and authorized execution of amendments to agreements with the City of Redwood City and the FOSMD; and

WHEREAS, it is necessary to amend the agreements approved by this Board on August 7, 2001, by Resolutions No. 64668 and 64669, that provide for the transmission of sanitary sewage from the TCSAD and the treatment thereof, in order for said property at 3373 Woodside Road to be included in and served by the TCSAD; and

WHEREAS, there has been presented to this Board, forms of amendments to said agreements, which have been executed by the Town of Woodside; and

WHEREAS, the Director of Public Works has recommended that the President of this Board be authorized to execute said amendments once the applicable fees are paid to FOSMD; and

WHEREAS, this Board has considered and concurs with the recommendation of the Director of Public Works.

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that:

1.

the President of this Board of Supervisors be, and is hereby, authorized and directed to execute:

a.

the amendment entitled “Fourth Amendment to the Agreement for Transmission of Sanitary Sewage by and between the Fair Oaks Sewer Maintenance District and the Town of Woodside;” and

b.

the amendment entitled “Fourth Amendment to Sanitary Sewage Treatment Capacity Rights and Services”

on behalf of FOSMD once the following fees have been paid:

The Town of Woodside shall provide payment equivalent to 1/3 of the FOSMD’s Annual Sewer Service Charge with their biannual payment to the FOSMD for sewer service.

The Clerk of the Board of Supervisors be, and is hereby authorized and directed to attest to the signature of the President to said amendments.
