Agreement with Michael Daly

 

RECOMMENDATION:

Adopt a resolution:

    A) Waiving the Request for Proposal process;

    B) Authorizing the execution of an Agreement with Michael Daly for consulting services in the amount of $166,400 for the period January 23, 2007 through December 31, 2007; and

    C) Authorizing the Chief Information Officer to execute subsequent amendments and minor modifications not to exceed $25,000.

This Agreement supports this goal because the contracted services will enable the County to further reduce our dependency on the County mainframe in anticipation of rising mainframe costs.

BACKGROUND:

The Criminal Justice Information System (CJIS) is a complex set of systems that have been used by the County’s criminal justice departments (Sheriff’s Office, District Attorney’s Office, Courts and Probation) since 1990. CJIS currently resides on the County mainframe computer, which is scheduled for elimination in FY 2007-08. The mainframe elimination project plan for CJIS, as with other mainframe systems, follows a phased approach; Phase-1 - Strategy development, followed by Phase-2 – Strategy-to-Action. Your Board approved, on August 16, 2005, an Agreement with MTG Management Consultants, LLC to accomplish Phase-1 for CJIS. The deliverable of this Agreement was a strategic plan for Criminal Justice Systems. Phase-1 for CJIS is now complete and the criminal justice departments are currently in the Proof-of-Concept stage of the project to migrate CJIS from the mainframe computer to alternative platforms. These current activities are part of Phase-2 – Strategy-to-Action.

 

DISCUSSION:

County staff, to include retained consultants, will work collaboratively with the migration vendor(s) to complete the project. The migration process, from Proof-of-Concept through transition to production use, is expected to continue through March 2008. Since ISD will continue to maintain CJIS through these project time lines, we recommend contractor support to offset the temporary increased workload associated with this project. Specifically, Mr. Daly will provide project management for one of the pilot conversion projects; in this role Mr. Daly will take responsibility for project plan development, schedule tracking, and technical evaluation of the delivered product. Additionally, during the conversion, Mr. Daly will assist as a COBOL programmer for data migrations and as a programming quality assurance lead during the acceptance phase.

Given the complexity of the CJIS system, the start-up time for new engineers joining this project is significant. The County has previously contracted with Mr. Daly to assist with CJIS programming and development. The most recent contract was a CMO level agreement to assist with the migration of Probation Accounting System data. He has proven to be a valuable asset for the CJIS project team and has demonstrated an understanding of the CJIS system, County standards, and working collaboratively with County staff. In addition, Mr. Daly has agreed to work at an hourly rate of $80 an hour which is below the market average of $150 per hour. Therefore, we believe that it is in the County’s best interest to waive the RFP process and execute this Agreement based upon the fact that My Daly has extensive experience with CJIS, expertise in our CJIS environment, and established familiarity with supporting County applications and is willing to work at a rate under the market average.

The contractor has assured compliance with the County's Contractor Employee Jury Service Ordinance, as well as all other contract provisions that are required by County ordinance and administrative memoranda, including but not limited to insurance, hold harmless, non-discrimination, and equal benefits.

County Counsel has reviewed and approved the Resolution and Agreement.

 

FISCAL IMPACT:

The term of this Agreement is from January 23, 2007 to December 31, 2007. The total obligation under this Agreement is $166,400 and funded entirely through the County’s criminal justice departments. Funds are included in ISD’s FY 2006-07 budget and will be included in ISD’s FY 2007-08 budget.
