Expedited Modifications Pilot Project

 

RECOMMENDATION:

Adopt a resolution supporting the San Mateo County Department of Child Support Services’ participation in the expedited modifications pilot project established by SB 1483.

Parents with child support orders that are appropriate for their income levels are more likely to pay child support. The SB 1483 pilot project will allow parents that agree on a new order amount to have a new order in three months or less rather than six months or longer under current law.

 

BACKGROUND:

Under current law, the modification of a child support order takes six months or longer to complete. In cases where the order increases, the custodial parent is not getting the support they should receive for that period. In cases where the obligor is unable to pay, they are accruing arrears for at least six months that they may not be able to pay. SB 1483 allows the child support agencies in San Mateo, Orange, Fresno, Alameda and Santa Clara counties to test an expedited procedure to modify child support orders when neither the Non-Custodial Parent (NCP) nor the Custodial Parent (CP) objects to the adjustment.

 

DISCUSSION:

SB 1483 requires each participating county to have a resolution of support from the Board of Supervisors. That requirement will be met by the adoption the resolution.

 

FISCAL IMPACT:

The expedited modifications pilot project will not create additional costs because it will simply offer a faster process to parties that are requesting modifications. Furthermore, the Department of Child Support Services is fully funded by the state and federal government. The Department has no Net County Cost.
