Adoption of standing resolutions authorizing the District Attorney’s office’s submission of annual grant proposals to the California Department of Insurance for grant monies to fund programs for the investigation and prosecution of automobile and workers’ compensation insurance fraud through fiscal year 2008-2009

 

RECOMMENDATION:

Adopt a resolution authorizing the District Attorney to submit annual grant proposals to the California Department of Insurance for programs for the investigation and prosecution of automobile and workers’ compensation insurance fraud through fiscal year 2008-2009

The Department of Insurance grants contribute to this goal by discouraging automobile and workers compensation insurance fraud throughout the County, thereby making San Mateo County a more attractive location for businesses.

 

BACKGROUND:

Since 1994, the Office of the District Attorney’s Automobile Insurance Fraud Program and Workers’ Compensation Insurance Fraud Program have been funded by grant monies applied for and received from the State of California as administered through the California Department of Insurance. Each year, in order to apply for and receive such grant monies for such projects, the Office of the District Attorney drafts and submits Board Memos and Resolutions authorizing the same. On June 20, 2006, the Board authorized the District Attorney’s office to apply for said grants, to accept said grant monies, and to execute the related grant award agreements for the 2006-2007 fiscal year.

 

DISCUSSION:

in the interests of efficiency, the Office of the District Attorney is requesting that this Board authorize the District Attorney to apply for and accept the above-referenced grant monies through and including the Fiscal Year 2008-2009. Such “standing resolutions” would obviate the need for the District Attorney to prepare and submit Board Memos and Resolutions each year. This Board has previously approved such standing resolutions with respect to the District Attorney’s application for and acceptance of grant monies related to its Statutory Rape Prosecution Program through the Fiscal Year 2008-2009. In 2009, prior to seeking an additional three-year authorization from the Board, the District Attorney will provide the Board with an update of the monies received through the fiscal year 2008-2009. The Department of Insurance grants do not require a County match or the commitment of additional County funds.

 

FISCAL IMPACT:

Historically, after the subject grants have been approved by the DOI, the combined insurance fraud grant programs have been fully funded by State and trust fund monies and the District Attorney’s Office has not exceeded the financial needs of such programs. In past years, this Board’s approval of the application and acceptance of these grants has had no fiscal impact on Net County Cost.
