RESOLUTION AUTHORIZING AND DIRECTING THE PRESIDENT OF THE BOARD OF SUPERVISORS TO EXECUTE A SETTLEMENT AND MUTUAL RELEASE AGREEMENT WITH TURNER CONSTRUCTION COMPANY

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, On October 22, 2002, by Resolution No. 65620, the Board of Supervisors authorized the County Manager’s Office to execute an agreement with Turner Construction Company (“Turner”) to provide construction management, architectural and engineering services for the construction of the San Mateo County Youth Services Center (the “Project”); and;

WHEREAS, the Project is now substantially complete and the COUNTY wishes to settle and resolve all issues between Turner and the County with regard to the Project; and;

WHEREAS, there has been presented to this Board of Supervisors for its consideration and acceptance, an Settlement and Mutual Release Agreement between the County of San Mateo and Turner, reference to which is hereby made for further particulars, and the Board of Supervisors has examined and approved the same as to form and content and desires to enter into the same.

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the President of the Board is hereby authorized and directed to execute the Settlement and Mutual Release Agreement between the County of San Mateo and Turner Construction Company, and the Clerk of the Board shall attest to her signature thereto.
