RESOLUTION AUTHORIZING AND DIRECTING THE PRESIDENT OF THE BOARD OF SUPERVISORS TO EXECUTE AN AGREEMENT PROVIDING FOR THE TRANSFER TO THE COUNTY IN FEE TITLE OF THREE PARCELS ON SAN BRUNO MOUNTAIN, THE PAYMENT TO THE COUNTY OF $234,038 FOR HABITAT RECLAMATION AND ASSOCIATED ACTIVITIES, AND TO FURTHER AUTHORIZE THE PRESIDENT OF THE BOARD OF SUPERVISORS TO EXECUTE AN ACCCEPTANCE OF SUCH TRANSFER AND SUCH OTHER DOCUMENTS AS MAY BE NECESSARY TO EFFECTUATE THE AGREEMENT

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, SunChase G.A. California I, Inc. (“Sunchase”) is the owner in fee title of certain properties designated Remainder Parcels 1, 2 and 6 on the subdivision map for the Terrabay Subdivision in the City of South San Francisco, containing approximately 108.8 acres; and

WHEREAS, the San Bruno Mountain Habitat Conservation Plan (“HCP”) requires that Sunchase dedicate these parcels in fee title to the County of San Mateo for inclusion in San Bruno Mountain County Park as Conserved Habitat; and

WHEREAS, the estimated cost of habitat reclamation, parcel staking and geotechnical review for the three parcels is $234,038, which estimate has been reviewed by the County Parks and Recreation Division, in consultation with the Habitat Manager for the HCP, and found adequate for that purpose; and

WHEREAS, the Board has been presented a form of agreement which would provide for the transfer in fee title of the three remainder parcels, the termination and abandonment of an existing offer to dedicate Parcels 1 and 2, the termination of an existing agreement regarding Parcels 1 and 2, and the payment of $234,038 to the County for habitat restoration activities, property staking and geotechnical review of the three parcels; and

WHEREAS, the Board has reviewed the proposed agreement and desires to enter into same;

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the President of the Board of Supervisors is hereby authorized and directed to execute the proposed agreement with Sunchase providing for the transfer in fee title of three parcels on San Bruno Mountain, the termination and abandonment of an existing offer to dedicate Parcels 1 and 2, the termination of an existing agreement regarding Parcel 1, and the payment of $234,038 to the County, $230,538 of which is to be placed in the San Bruno Mountain Habitat Conservation Trust Fund for habitat reclamation activities and staking of parcels, and the remainder of which is to compensate the County for geotechnical review, and further authorizes the President of the Board to execute any and all documents necessary to effectuate the agreement, including but not limited to certificates of acceptance for each of the parcels.
