RESOLUTION INCREASING THE ANNUAL FEE FOR MEDICAL MARIJUANA IDENTIFICATION CARDS TO $174.00 AND ALLOWING THE HEALTH DEPARTMENT DIRECTOR TO AUTHORIZE FUTURE FEE INCREASES BASED ON STATE REQUIREMENTS

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, in 1996 the voters of the State of California approved Proposition 215, also known as the Compassionate Use Act of 1996, which authorizes the use of marijuana for medical purposes; and

 

WHEREAS, Health and Safety Code §11362.71 requires each county health department to establish and maintain a system to authorize Medical Marijuana Identification Cards; and

 

WHEREAS, Health and Safety Code §11362.755 authorizes each county health department to charge a fee for all costs incurred by the county or the county’s designee for administering the program; and

 

WHEREAS, this Board finds that the County’s cost to process these cards is $32.00 per card, based upon staff time, equipment and supplies; and

 

WHEREAS, the cost of the card also includes a fee that is transmitted to the State, and the State has recently notified the Health Department of a required per card increase of $129.00, from $13.00 to $142.00, effective March 1, 2007; and

 

WHEREAS, the State has indicated that there may be additional adjustments to the State’s fee on an annual basis:

 

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the fee for processing and issuing Medical Marijuana Identification Cards is set at $174.00, effective March 1, 2007.

 

BE IT FURTHER RESOLVED that the Health Director is hereby authorized to adjust the fee for processing and issuing Medical Marijuana Identification cards to reflect increases or decreases in the portion of the fee that must be transmitted to the State.
