BOARD OF SUPERVISORS, COUNTY OF SAN MATEO, STATE OF CALIFORNIA

RESOLUTION AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH THE CROSSINGS PHASE II, L.P. IN THE AMOUNT OF $600,000 TO PROVIDE FUNDING TO ASSIST IN THE DEVELOPMENT OF PHASE II OF THE VILLAGE AT THE CROSSING SENIOR HOUSING FOR THE TERM BEGINNING UPON EXECUTION THROUGH JUNE 30,2009

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, pursuant to Government Code, Section 31000, County may contract with independent contractors for the furnishing of special services to or for County or any Department thereof; and

WHEREAS, CROSSINGS PHASE II, L.P. applied for funding assistance for the development of the Crossings Senior Housing Phase II (“Project”), both phases I and II now known as the Village at the Crossing, a rental community of 228 units for seniors age 55+, located at National Avenue and Commodore Drive in San Bruno, near El Camino Real and the Tanforan Shopping Center; and

WHEREAS, each phase consists of 114 units each, for a total of 228 units; and

WHEREAS, this Board, on June 7, 2005, by Resolution Number 067345, approved $1.7 million of FY 2004-05 CDBG funds for Phase 1; and

WHEREAS, on May 3, 2005, this Board approved the FY 2005-06 CDBG/ESG/ HOME Action Plan, which included $600,000 HOME funding for the Project; and

WHEREAS, both County and CROSSINGS PHASE II, L.P. now wish to enter into an Agreement to provide funding assistance for the Project for a total obligation of $600,000 for the period beginning upon execution to June 30, 2009; and

WHEREAS, there has been presented to this Board of Supervisors for its consideration and acceptance, an Agreement between the County of San Mateo and CROSSINGS PHASE II, L.P., reference to which is hereby made for further particulars, and the Board of Supervisors has examined and approved the same as to form and content and desires to enter into the same.

NOW, THEREFORE, IT IS HEREBY RESOLVED that the President of this Board of Supervisors be, and is hereby authorized and directed to execute said Agreement for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest the President’s signature thereto.

BE IT FURTHER RESOLVED, that the Director of the Department of Housing or the Director’s designee shall be authorized to execute contract amendments which modify the County's maximum fiscal obligation by no more than $25,000 (in aggregate), and/or modify the contract term and/or services so long as the modified term or services is/are within the current or revised fiscal provisions.
