RESOLUTION AUTHORIZING THE PRESIDENT OF THE BOARD TO EXECUTE AN AGREEMENT WITH COTCHETT, PITRE & MCCARTHY FOR LEGAL SERVICES FOR THE MATTER OF COUNTY OF SANTA CLARA V. ATLANTIC RICHFIELD COMPANY ET AL.

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, the presence of lead products for use in paint coatings on homes in buildings in San Mateo County poses serious health hazards. On November 14, 2006, the Board authorized the County’s joining of litigation brought by several cities and counties against certain manufactures of lead based products; and

WHEREAS, the law firm of Cotchett, Pitre and McCarthy (“Cotchett”) has been retained to assist several cities and counties entities in the litigation; and

WHEREAS, the Board of Supervisors has examined and approved the agreement with Cotchett for legal services as to form and content and desires to enter into same:

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the Board of Supervisors is hereby authorized and directed to execute said agreement for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest the President’s signature thereto.
