Resolution Authorizing the Execution of a First Amendment to Agreement between the County of San Mateo / Half Moon Bay Airport and Mavericks Surf Ventures, LLC and Extending the Term of the Sheriff’s Authority to Restrict the Use of or to Close Certain County Highways, as Set Forth in Board of Supervisors Resolution No. 068403

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, on January 9, 2007, County of San Mateo (“County”) and Mavericks Surf Ventures, LLC (“Operator”), as authorized by Resolution No. 068469, entered into an Agreement for the use of the Half Moon Bay Airport (“Airport”) for spectator parking related to the Mavericks Surfing Contest (“Contest”) at Half Moon Bay, California; and

WHEREAS, surf conditions may prevent the Operator from holding the Contest during the term of the agreement; and

WHEREAS, the parties wish to amend the Agreement to extend the term through April 22, 2007, with one option to extend for one additional month on the same terms and conditions contained in the Agreement; and

WHEREAS, this Board has been presented with the First Amendment to Agreement and has examined and approved same as to both form and content and desires to enter into same; and

WHEREAS, on December 5, 2006, this Board of Supervisors adopted Resolution No. 068403, which authorized the Sheriff to restrict the use of or close certain County highways on the grounds it would enhance the protection of the public during the day of the Mavericks Surfing Competition in 2007, and this Board now wishes to extend the Sheriff’s authority to do so in the event the competition takes place after March 31, 2007.

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the President of this Board of Supervisors be, and is hereby, authorized and directed to execute said First Amendment to Agreement for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest the President’s signature thereto; and

IT IS FURTHER DETERMINED AND ORDERED that the County Manager or his designee is hereby authorized to accept or execute on behalf of the County, any and all notices, options, consents, approvals, terminations and documents in connection with the Agreement and Amendment; and

IT IS FURTHER DETERMINED AND ORDERED that the Sheriff’s authority to restrict the use of or close certain County highways, as set forth in Board of Supervisors Resolution No. 068403, is extended to the day after the 2007 Mavericks Surfing Competition, in the event the competition takes place during the term authorized by the First Amendment to the agreement between the County of San Mateo / Half Moon Bay Airport and Mavericks Surf Ventures, LLC, which amendment is authorized by this resolution.
