Amendment to the Agreement with Daniel Buckley, MD for Ophthalmology Services

 

RECOMMENDATION:

Adopt a Resolution authorizing the execution of an Amendment to the Agreement with Daniel Buckley, MD, to provide ophthalmology services for the period from September 1, 2004 through August 31, 2006 increasing the maximum amount payable thereunder by $8,500, from $115,669.38 to $124,169.38.

BACKGROUND:

Dr. Daniel Buckley was party to a contract with San Mateo Medical Center (SMMC) for ophthalmology for the period from September 1, 2004 through August 31, 2006 with a maximum amount payable thereunder of $115,669.38. Dr. Daniel Buckley has provided ophthalmology services to the patients of SMMC for the last several years. In particular, these services include the diagnosis and treatment for diseases of the eye, including glaucoma surgery, cataract surgery, and clinics for eye injury, trauma, or refractive corrections. Patients treated at SMMC have a continuous need for such eye care services and Dr. Buckley offers the hospital the benefits of an experienced provider familiar with the complex nature of the County’s patient base.

 

DISCUSSION:

In 2004 eye injury, trauma, disease, and surgery services for San Mateo Medical Center were contracted among four ophthalmologists. One of the contractors terminated his contract with the County in January 2005. Another reduced their availability for services in April 2005. In response to these developments, Dr. Daniel Buckley agreed to increase his availability to cover the service gap, and he consequently saw more patients and provided more services than anticipated when he entered into his contract with the County.

The original Agreement was based on an annual productivity level that did not reflect Dr. Buckley’s assumption of part of the terminated contractors’ workload. A portion of funds budgeted for another ophthalmologist which contract terminated in January 2005 was shifted to cover the increased financial obligation for this amendment which would be $8,500.

Due to vacancies in the SMMC’s contracting department, it was unable to complete the contract amendment process during the term of the Agreement. Dr. Buckley continues as a contractor with the County and the SMMC recommends that the County compensate Dr. Buckley for the additional $8,500 earned during the expired contract term.

 

FISCAL IMPACT:

The term of the Agreement with Dr. Buckley is September 1, 2004 to August 31, 2006, with a maximum amount of $115,669.38. The term of the Agreement remains the same. The Amendment increases the maximum amount of the Agreement by $8,500 to $124,169.38. Funds were included in San Mateo Medical Center’s FY2004-05 and FY2005-06 Adopted Budget.
