RESOLUTION 1) AUTHORIZING THE PRESIDENT OF THE BOARD TO EXECUTE AGREEMENT NUMBER 06-55637 WITH THE STATE DEPARTMENT OF HEALTH SERVICES FOR THE AIDS MEDI-CAL WAIVER PROGRAM FOR THE TERM JANUARY 1, 2007 THROUGH DECEMBER 31, 2009; AND 2) AUTHORIZING THE HEALTH DEPARTMENT DIRECTOR OR THE DIRECTOR'S DESIGNEE TO EXECUTE CONTRACT AMENDMENTS WHICH MODIFY THE COUNTY'S MAXIMUM FISCAL OBLIGATION BY NO MORE THAN $25,000 (IN AGGREGATE), AND/OR MODIFY THE CONTRACT TERM AND/OR SERVICES SO LONG AS THE MODIFIED TERM OR SERVICES IS/ARE WITHIN THE CURRENT OR REVISED FISCAL PROVISIONS

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, there has been presented to this Board of Supervisors for its consideration and acceptance an Agreement with the State Department of Health Services to provide case management, skilled nursing care, attendant care, psychotherapy, homemaker services, nutritional counseling, nutritional supplements, home delivered meals, specialized medical equipment and supplies, minor adaptations to the home, Medi-Cal supplements for infants and children in foster care, and non-emergency medical transportation services to people with HIV Disease or AIDS with current symptoms through the AIDS Medi-Cal Waiver Program; and

WHEREAS, both parties now wish to enter into an Agreement to provide AIDS Medi-Cal Waiver Program services for the period of January 1, 2007 through December 31, 2009, for a total obligation of an annual cost cap per AIDS Waiver client of $13,209; and

WHEREAS, there has been presented to the Board of Supervisors for its consideration and acceptance, an Agreement with the State of California, reference to which is hereby made for further particulars, and the Board of Supervisors has examined and approved the same as to form and content and desires to enter into the same:

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that Agreement Number 06-55637 with the State Department of Health Services for the AIDS Medi-Cal Waiver Program is hereby approved, and the President of this Board of Supervisors is hereby authorized and directed to execute the aforesaid Agreement for and on behalf of the County of San Mateo, and the Clerk of the Board shall attest the President’s signature thereto.

BE IT FURTHER RESOLVED that the Health Department Director or the Director’s designee is authorized to execute contract amendments which modify the County's maximum fiscal obligation by no more than $25,000 (in aggregate), and/or modify the contract term and/or services so long as the modified term or services is/are within the current or revised fiscal provisions.
