RESOLUTION AUTHORIZING DISCHARGE FROM ACCOUNTABILITY FOR COLLECTION OF CIVIL PENALTIES AND CRIMINAL FINES RELATING TO CONSUMER FRAUD JUDGMENTS

 

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that:

 

WHEREAS, Under Government Code sections 25257 and 25258, the Board of Supervisors can discharge the County from continued efforts to collect funds owed to the County; and

 

WHEREAS, the accounts presented for discharge from accountability for the collection thereof are too small to justify the cost of collection, the likelihood of collection does not warrant the expense involved, or the amount thereof has been otherwise lawfully compromised or adjusted; and

 

WHEREAS, the amount of abandonment of collection effort and relief of accountability for civil penalties ordered pursuant to judgments from civil law enforcement cases is in the amount of $363,750.44 and for criminal fines ordered from criminal convictions is in the amount of $2,887.37; and

 

WHEREAS, the Board of Supervisors, desires to terminate any further efforts in the collection of these accounts.

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the accounts presented are not collectable and the County is hereby discharged from continued efforts to collect funds owed to the County; and

 

BE IT FURTHER RESOLVED that the District Attorney’s Office is discharged from accountability of the accounts presented.
