SUBJECT:

Amendment to resolutions expressing salaries and benefits of unrepresented attorneys and management attorneys in the District Attorney and County Counsel offices.

 

RECOMMENDATION: Adopt a resolution amending resolutions 068419 and 068420 to adjust the salaries of unrepresented attorneys and management attorneys in the District Attorney and County Counsel offices.

 

BACKGROUND:

Salaries for the unrepresented attorney’s unit personnel are contained in resolution 068420 “Resolution expressing the salary and benefits of unrepresented attorney’s employees of the County of San Mateo”, which was adopted by this Board on December 5, 2006.

 

Salaries for the District Attorney and the County Counsel as well as the attorney managers in the District Attorney and County Counsel offices are contained in resolution 068419 “Resolution expressing the salary and benefits of unrepresented management personnel of the County of San Mateo”, which was adopted by this Board on December 5, 2006.

 

DISCUSSION:

Recently, a survey was undertaken to compare the salary and benefits of similar attorney positions in the Offices of the District Attorney and the County Counsel in four of our neighboring counties: Santa Clara, San Francisco, Contra Costa and Alameda which are typically used for salary comparison purposes. Three of the four counties have had recent significant salary increases. For example, in Santa Clara the highest non-management deputies have annual salaries of approximately $186,000 compared to the approximately $154,000 paid to similarly situated attorneys here. This has created significant issues for retention and recruitment of attorneys. Based upon the findings, it was determined by the County Manager, District Attorney, County Counsel, and Human Resources that the salaries for attorneys should be increased so as to fall within the median of the salaries paid by the mid range counties of San Francisco and Alameda. Such an increase will enable the County to stay competitive with our neighboring counties in the recruitment and retention of highly qualified attorneys. The salaries for the District Attorney, the County Counsel, and the attorney managers will be similarly increased.

 

The attached resolution amends the salary schedules for attorneys in the District Attorney and County Counsel offices. It also amends the salary schedules for the District Attorney and the County Counsel as well as the management attorneys in those two offices. If adopted, these changes would be effective for the pay period commencing May 20, 2007, except for the County Counsel, whose salary change will take effect September 2, 2007.

 

FISCAL IMPACT:

The annual impact of the increase is approximately $1.3 million.
