TO:

Honorable Board of Supervisors

FROM:

James C. Porter, Director of Public Works

SUBJECT:

Annexation of Property to the Emerald Lake Heights Sewer Maintenance District - Lands of Bechwati (579 California Way,
APN 068-173-050 & 068-173-060) Redwood City Area

Recommendation

Acting as the governing board of the Emerald Lake Heights Sewer Maintenance District (District), adopt a resolution setting a time and place for a public hearing to consider the proposed annexation of the Lands of Bechwati to the Emerald Lake Heights Sewer Maintenance District.

Vision Alignment

Commitment: Ensure basic health and safety for all.

Goal 7: Maintain and enhance the public safety for all residents and visitors.

Your Board authorizing a public hearing to consider the proposed annexation can result in providing effective sanitary sewer service to a parcel in a suburban area that would otherwise use an “on-site” method to handle wastewater, which could have an impact on neighboring residents.

Background

Previous Board Action

Entered into an agreement (Agreement) with the City of Redwood City (City) that allows the District to provide sewer service to properties within the corporate limits of the City that are adjacent to District-owned and operated facilities.

History

The Agreement requires properties within the City that are proposed to be served by the District to be annexed to the District, and also requires the City to approve said annexations into the District. The City adopted Resolution No. 14265 on July 9, 2001 (attached), consenting to the proposed annexation of this property and executing Supplemental Agreement No. 30 to the Agreement. The annexation was not completed in 2001, at the request of the previous property owner. A public hearing to consider an annexation to the District is required pursuant to Section 4860 et seq. of the Health and Safety Code.

Discussion

Georges Bechwati and Leila Bechwati are the current owners of the property within the City of Redwood City at 579 California Way, which is also identified as Assessor’s Parcels Number 068-173-050 and 068-173-060. They have requested that their property be annexed to the District in order to receive sewer service.

We have determined that the property can be served through the facilities of the District, and are recommending that a public hearing be set for your regular meeting of June 19, 2007, at 9:30 a.m., to consider the proposed annexation.

A resolution has been approved as to form by County Counsel, and we will post and publish the required notices if your Board adopts the proposed resolution.

Fiscal Impact

The property owner has paid or will pay all required fees for the parcel as follows:

Ø

Annexation Processing Fee:

$800

Ø

District Connection Fees:

$16,854

Ø

State Board of Equalization's Recording and Mapping Fee:

$300

Ø

Redwood City Sewer Facilities Fee:

$960

Ø

Redwood City Wastewater Treatment Fee:

$715.50

Ø

Sewer Inspection Permit Fee:

$100

The property owner will be subject to the annual sewer service charge levied by the District, currently $428 per year, and will also be required to construct and pay for the sewer main extension and sewer lateral that is necessary to bring sewer service to this property, if the annexation is approved and sewer service provided.

There is no impact on the General Fund.
