County Service Area. 8 (North Fair Oaks)”

Adoption of the Proposed Garbage and Recyclables Collection Rates in County Service Area No. 8 (North Fair Oaks). Authorize the Director of Public Works to Notify Each Property Owner of the Hearing and Proposed Rates

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, San Mateo County Ordinance Code Section 4.04.170 et. seq. requires that refuse and garbage collection charges in County Service Area No. 8 shall be collected on the tax roll in accordance with the amounts shown for each parcel of real property receiving such service as shown in a written report filed with the Clerk of the Board; and

 

WHEREAS, that certain franchise agreement entitled Franchise Agreement between the County of San Mateo and Allied Waste Services for Solid Waste, Recyclable Materials and Plant Materials Collection Services (“Franchise Agreement”) was approved by the County of San Mateo on February 8, 2000, and was effective January 1, 2000; and

 

WHEREAS, the Franchise Agreement sets forth the terms and conditions of solid waste, recyclable materials and plant materials collection services in County Service Area No. 8 (CSA-8); and

 

WHEREAS, Section 6.10 of the Franchise Agreement provides that this Board may revise the garbage collection rates for CSA-8 by resolution of this Board, and this Board finds it is necessary and desirable to adopt said Exhibit “A” for 2007/2008 FY and Exhibit “B for 2008/2009 FY as the proposed rate schedule for garbage collection in CSA-8.

 

WHEREAS, San Mateo County Ordinance Code Section 4.04.170 et. seq. also requires that notice of filing of said written report and of the time and place of a hearing thereon to be published once a week for two successive weeks prior to the date set for hearing in a newspaper of general circulation in CSA-8.

 

WHEREAS, Article XIIIC and XIID of the State Constitution Proposition 218 requires an individual notice of the hearing to consider any new or increased property related fees including garbage collection charges, and a mechanism for rejecting fees via a majority protest at a public hearing.

 

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that:

Tuesday, July 10, 2007, at 9:15 A.M., in the Chambers of the Board of Supervisors of the County of San Mateo, in the Hall of Justice and Records, Redwood City, California, is hereby fixed as the time and place of the hearing on the filing of the 2007/2008 Garbage and Recyclables Collection Charges Report for County Service Area No. 8 with the Clerk of this Board.

The Director of Public Works shall cause a copy of the “NOTICE OF PUBLIC HEARING,” attached hereto, to be published once a week for two successive weeks prior to the date set for hearing in the Independent Newspaper Group, a newspaper of general circulation in County Service Area No. 8.

   
 

The Director of Public Works will notify each owner of each property of the notice of the proposed public hearing and the proposed new annual charges for the next two fiscal years.

   

3.

The service charge to be used in preparing the Garbage and Recyclables Service Charges Report for County Service Area No. 8 shall be $19.69 per pickup unit in FY 2007/2008 and $20.93 per pickup unit in FY 2008/2009, until said charge is changed by a subsequent action of this Board.

Exhibit “A” attached hereto, and made a part hereof by reference, is adopted as the garbage collection rate schedule for services provided pursuant to the Franchise Agreement for County Service Area No. 8, effective July 1, 2007, and Exhibit “B” attached hereto, and made a part hereof by reference, is adopted as the garbage collection rate schedule for services provided pursuant to the Franchise Agreement for County Service Area No. 8, effective January 1, 2008.
