Annexation of Property to the Emerald Lake Heights Sewer Maintenance District - Lands of Bechwati (579 California Way,
APN 068-173-050 & 068-173-060) Redwood City Area

 

Recommendation

Acting as the governing board of the Emerald Lake Heights Sewer Maintenance District and after conducting the public hearing, adopt a resolution:

 

1.

Ordering the annexation of the Lands of Bechwati to the Emerald Lake Heights Sewer Maintenance District (District) and authorizing the President of the Board to execute Supplemental Agreement No. 30 to the Agreement.

 

2.

Directing the Director of Public Works to transmit a copy of the resolution ordering annexation along with the executed duplicate original Supplemental Agreement No. 30 to the City of Redwood City.

3.

Directing the Director of Public Works to transmit a copy of the resolution ordering annexation to the County Assessor and the State Board of Equalization.

Your Board authorizing the proposed annexation can result in the District providing sanitary sewer service to a parcel in a suburban area that would otherwise use an “on-site” method to handle wastewater, which could have an impact on neighboring residents.

 

Background

Previous Board Action

1.

Entered into a City of Redwood City/District Transmission Agreement (Agreement) with the City of Redwood City (City) that allows the District to provide sewer service to properties within the corporate limits of the City that are adjacent to District-owned and operated facilities.

Set 9:30 a.m. on Tuesday, June 19, 2007, in your Chambers, as the time and place of a public hearing to consider the annexation of the Lands of Bechwati to the District.

 

History

Georges Bechwati and Leila Bechwati are the current owners of the property within Redwood City at 579 California Way, which is also identified as Assessor’s Parcel Numbers 068-173-050 and 068-173-060. They have requested that their property be annexed to the District in order to receive sewer service.

 

The Agreement requires properties within the City that will be served by the District, to be annexed to the District.

 

A public hearing to consider an annexation to the District is required pursuant to Section 4860 et seq. of the Health and Safety Code.

 

Discussion

The public hearing to consider the proposed annexation has been properly noticed and the appropriate description prepared.

 

A resolution and supplemental agreement have been approved as to form by County Counsel and the City has consented to the proposed annexation and has executed Supplemental Agreement No. 30 to the Agreement.

 

The District is able to provide sewer service to the property. Therefore, we are recommending that the annexation be approved.

The property owner will be subject to the annual sewer service charge levied by the District, currently $428 per year, and will also be required to construct and pay for the sewer main extension and sewer lateral that is necessary to bring sewer service to this property, if the annexation is approved and sewer service provided.

 

There is no impact to the General Fund.
