BOARD OF SUPERVISORS, COUNTY OF SAN MATEO, STATE OF CALIFORNIA

RESOLUTION:

1.

WAIVING THE REQUEST FOR PROPOSALS (RFP) PROCESS FOR MAINTENANCE AND SUPPORT OF THE SHERIFF'S OFFICE RECORDS MANAGEMENT SYSTEM (RMS); AND

2.

AUTHORIZING THE SHERIFF TO EXECUTE AN AMENDMENT TO THE SOFTWARE LICENSE AND MASTER SUPPORT AGREEMENT WITH TIBURON, INC. FOR MAINTENANCE AND SUPPORT OF THE SHERIFF'S OFFICE RECORDS MANAGEMENT SYSTEM (RMS), EXTENDING THE TERM FROM FEBRUARY 14, 2007 TO FEBRUARY 14, 2008, WITH AN OPTION TO EXTEND FOR TWO ADDITIONAL ONE-YEAR TERMS, AND INCREASING THE AMOUNT OF THE SOFTWARE LICENSE AND MASTER SUPPORT AGREEMENT BY $75,683, FROM $0 TO $75,683, FOR A TOTAL INCREASE NOT TO EXCEED $250,000 FOR THE THREE ONE-YEAR EXTENSIONS.

 

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that:

WHEREAS, Ordinance Code Section 2.92.160 authorizes the Board of Supervisors to waive the Request for Proposals (RFP) process in any situation where the Board of Supervisors determines that the best interest of the County could be served without the necessity of proposals; and

    WHEREAS, this Board has been asked to waive the Request for Proposals requirements in order for the Sheriff's Office to contract with this provider to maintain and support of the Sheriff's Office Records Management System; and

    WHEREAS, this Board has determined that it is in the best interest of the County to waive the Request for Proposals process; and

    WHEREAS, on December 17, 2002, your Board adopted Resolution # 65711, authorized the President of the Board to execute a master agreement in the amount of $1,558,386 with Tiburon, Inc. for the implementation of the Sheriff's Office Records Management System (RMS), and delegated to the Sheriff the authority to execute a software license agreement (at no additional cost) at a further point; and

WHEREAS, on May 4, 2004, the software license and master support agreement with Tiburon, Inc. was executed by the Sheriff for the term May 4, 2004 through February 14, 2007 at $0; and

WHEREAS, both parties now wish to enter into up to three one-year amendments to the software license and master support agreement with Tiburon, Inc. for maintenance and support of the Sheriff's Office Records Management System, extending the term from February 14, 2007 to February 14, 2008, with an option to extend for two additional one-year terms, and increasing the amount of the software license and master support agreement by $75,683, from $0 to $75,683, for a total increase not to exceed $250,000 for the three one-year extensions:

    NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the County requirement for the Request for Proposal process for said agreement is hereby waived; and

    BE IT RESOLVED that the Sheriff is hereby authorized and directed to execute up to three one-year amendments to the software license and master support agreement with Tiburon, Inc. for maintenance and support of the Sheriff's Office Records Management System extending the term from February 14, 2007 to February 14, 2008, with an option to extend for two additional one-year terms, and increasing the amount of the software license and master support agreement by $75,683, from $0 to $75,683, for a total increase not to exceed $250,000 for the three one-year extensions.
