Second Amendment to Agreement with Telecare Corporation for services at Cordilleras Mental Health Center

   

RECOMMENDATION:

Adopt a Resolution authorizing the President of the Board to execute a Second Amendment to the Agreement with Telecare Corporation for services at Cordilleras Mental Health Center to increase the maximum obligation by $130,901 to a new maximum of $13,709,686 with no change to the term of the Agreement.

This Agreement contributes to this commitment and goal through the provision of inpatient and residential psychiatric treatment services and direct observation therapy for non-adherent Tuberculosis patients at Cordilleras Mental Health Center.

BACKGROUND:

Telecare Corporation has provided inpatient and residential psychiatric treatment services for San Mateo County residents at Cordilleras Mental Health Center in Redwood City since 1982. Telecare treats up to 110 seriously mentally ill San Mateo County residents through the operation of a locked Mental Health Rehabilitation Center (MHRC) and residential care services supported by an assertive treatment team. It also provides a direct observation therapy (DOT) program for non-adherent Tuberculosis patients. On December 13, 2005, by Resolution 67720 your Board approved our current Agreement with Telecare for the term July 1, 2005 through June 30, 2007, including authorizing the Director of Health to approve amendments up to an aggregate amount of $25,000. On June 21, 2006, the Director of Health approved a First Amendment to the Agreement to revise the payment structure for DOT services, increasing the Agreement maximum by $2,920 with no change to the term.

 

DISCUSSION:

Since the Agreement was approved, Telecare has had unanticipated cost increases in several areas. These include: new licensing costs instituted by the State Department of Mental Health, higher prices for natural gas and utility cost increases, increases in the cost of employee healthcare benefits, and an increase in the cost of food. In addition, Telecare will make several improvements to the client living areas at the facility. These improvements have been approved by Public Works. The Agreement is being amended to increase the maximum obligation by $130,901 for FY 2006-07 for Mental Health Services in order to meet these increased costs. Revised payment provisions are also being added for the Public Health funded Direct Observation Therapy (DOT) for non-compliant Tuberculosis patients with no change to the Public Health costs. New Jury Duty language is being added to the Agreement as well. Changes have been made in Exhibit A section IIB5, and in Exhibit B, sections I, IIG, IIH - J, IIIA1, IIIA3, IIIA5, IIIC and IIIF. This Amendment is late due to clarification of the DOT language and staff shortage due to a temporary vacancy in the Mental Health contracts unit.

 

The Amendment to the Agreement has been reviewed and approved by County Counsel and Risk Management. The contractor has assured compliance with the County's Contractor Employee Jury Service Ordinance, as well as all other contract provisions that are required by County ordinance and administrative memoranda, including but not limited to insurance, hold harmless, non-discrimination and equal benefits.

 

FISCAL IMPACT:

The term of the amended Agreement remains July 1, 2005 through June 30, 2007. The Agreement maximum for the two-year period is being increased by $130,901 to a new maximum of $13,709,686. The combined FY 2006-07 Agreement maximum for Mental Health and Public Health is $7,019,070.

 

For Mental Health Services, the new maximum for FY 2006-07 is $6,913,585 which is included in the Mental Health Services' FY 2006-07 Adopted Budget. State and federal Medi-Cal will fund 4.1% or $283,457. Sales tax revenues provided through Realignment will pay $5,909,732. The Net County Cost is $720,396 as maintenance of effort for Realignment.
