Agreement with Gene Bruce, M.D.

 

RECOMMENDATION:

Adopt a resolution:

1. Authorizing the President of the Board to execute an Agreement with Gene Bruce, M.D. for specialty orthopedic services for the period April 12, 2007 through March 31, 2009 in an amount not to exceed $293,697.

2. Authorizing the Interim Chief Executive Officer (CEO) of San Mateo Medical Center or the CEO’s designee to execute contract amendments which modify the County’s maximum fiscal obligation by no more than $25,000 (in aggregate), and/or modify the contract term and/or services so long as the modified term or services is/are within the current or revised fiscal provisions.

BACKGROUND:

San Mateo County is responsible for providing necessary medical care to its medically indigent population and access to services to its general population. This care includes professional, specialty, orthopedic services and the management and supervision of those services. Gene Bruce, M.D. provides professional specialty orthopedic services.

 

DISCUSSION:

Dr. Bruce has provided orthopedic services at San Mateo Medical Center (SMMC) for the past five years and will continue to provide, at minimum, the same level of services as the previous agreement. The County need for orthopedic services is increasing. SMMC will be capable of continuing to meet this growing need through contracts with Dr. Bruce and other orthopedists, including the addition of an orthopedist in the fall. Orthopedic services are provided under the direction of the Interim Chief Executive Officer of SMMC, the Quality Assurance Committee and the Executive Committee of the Medical Staff.

This Agreement incorporates current HIPAA language. Risk Management and County Counsel have approved the Agreement. The Contractor has assured compliance with the County's Contractor Employee Jury Service Ordinance, as well as all other contract provisions that are required by County ordinance and administrative memoranda, including but not limited to insurance, hold harmless, non-discrimination and equal benefits.

FISCAL IMPACT:

The term of this Agreement is for two years from April 1, 2007 through March 31, 2009. Each year reflects a 3.5% increase in rates over the previous contract year and is substantially lower than the Contractor’s original requested increase. Funding for this Agreement is included in the FY 2006-07 Approved Budget and the FY 2007-08 Proposed Budget. The maximum amount the County shall be obligated to pay Contractor under this Agreement is $293,697.
