Resolution Authorizing the Director of Public Works to Set Aside $25,000 in Road Fund Contingencies as a Financial Assurance for the Reclamation of the Pescadero Quarry

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, San Mateo County, as owner of the Pescadero Quarry, is obligated pursuant to the State Surface Mining and Reclamation Act to complete the reclamation of the Pescadero Quarry; and

 

WHEREAS, an assurance is required to guarantee the reclamation plan will be completed, and said assurance must meet the requirements of the Surface Mining and Reclamation Act (Public Resources Code Section 2710 et seq.); and

 

WHEREAS, Section 3806.2 of Title 14 of the California Code of Regulations provides that: 1) a specific fund or line item set aside will meet the requirements of the Section 2773.1 of the Public Resources Code; and 2) the set aside shall contain the types and sources of specific funds, the period of time that each funding source is to be available, and the calculation amount of the financial assurance prepared pursuant to Section 3804.

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that:

The Director of Public Works is hereby authorized to set aside $25,000 in the Road Fund Budget in a Contingency Line Item for Fiscal Year 2007-2008, for the expressed purpose of providing assurances that the reclamation of the Pescadero Quarry will be implemented. This amount is based on the estimated cost of providing the work necessary to complete the work identified in the reclamation plan.

The County’s Planning and Building Department, as the lead agency for the State, is authorized to expend the funds set aside in the Road Fund Contingency, as necessary to complete the work contemplated by said reclamation plan, upon the presentation of evidence and confirmation by this Board that the Department of Public Works is incapable of performing the reclamation work guaranteed by the assurance in the Road Fund Contingency.
