Acceptance of the Final Map, Dedication of Public Utility Easements and Agreement for the Construction of Improvements Associated with the “Rathgar Estates” Subdivision, Redwood City Area

 

Recommendation

Adopt a resolution:

 

1.

Approving the Final Map for Subdivision PLN2000-00746 (Final Map); and

 

2.

Accepting the offer of dedication of Public Utility Easements as shown on said Final Map; and

   

3.

Directing the Clerk of the Board to execute the appropriate certificate on the Final Map and file the Map for record; and

   

4.

Authorizing the President of the Board to execute a secured agreement for the construction of improvements within the Rathgar Estates Subdivision (APN 051-040-140, File No. PLN 2000-00823).

Your Board accepting the offer of dedication will allow the subdivision map to be recorded.

 

The proposed agreement guarantees that subdivision improvements, as required by the County’s subdivision ordinance and regulations, will be constructed as part of this development. The subdivision map is in conformance with the County’s subdivision ordinance.

 

Background

 

Previous Board Action

Adopted Section 3.4 of the County Subdivision Ordinance that requires subdividers to provide public works improvements as a condition of subdivision approval.

 

History

The subdivider has prepared improvement plans for the proposed subdivision referenced above, which have been approved by the Department of Public Works. The scope of work includes constructing a private access road, providing drainage improvements and installing utilities to serve the approved major subdivision. An agreement has also been prepared whereby the subdivider agrees to construct the necessary improvements that were conditions of approval for the subdivision.

 

Section 7035 of the County Subdivision Regulations also requires regular and final inspections of subdivision improvements, and requires the subdivider to pay the actual costs incurred by the County for said inspections.

 

Discussion

The agreement for the improvements is secured by a Faithful Performance Bond in the amount of $440,000 to guarantee the performance of the work, and by a Payment Security in the amount of $220,000 to secure payments for labor and materials.

 

The performance bond will be released upon satisfactory completion of the improvements and after the posting of securities in the amount of fifty percent (50%) of the cost of construction to guarantee the work for one year following acceptance by the County.

 

The subdivider will also pay the costs of regular and final inspections provided by the Department of Public Works. A deposit in the amount of $5,000 has been paid by the subdivider and will be supplemented if necessary.

 

A resolution and agreement have been approved as to form by County Counsel, and the agreement has been executed by the subdivider.

 

Fiscal Impact

The County has no financial obligation as a result of this agreement.
