RESOLUTION MAKING THE FINDING THAT THE LIKELIHOOD OF COLLECTION OF DELINQUENT ACCOUNT LEASE NO. 5022 BETWEEN COYOTE RESTAURANT CORPORATION AND THE COUNTY OF SAN MATEO DOES NOT WARRANT THE EXPENSE INVOLVED TO COLLECT AND DISCHARGING THE DEPARTMENT OF PARKS FROM ACCOUNTABILITY FOR COLLECTION OF THIS ACCOUNT

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, the Board of Supervisors terminated Lease No. 5022 with Coyote Restaurant Corporation on February 27, 2007 due to abandonment of the property by the tenant and inability to collect past due rent from them since July 2006; and

 

WHEREAS, Coyote Restaurant Corporation maintains it has no assets from which to pay the past due rent in the amount of $5,600; and

 

WHEREAS, under Government Code Sections 25257 and 25258, the Board of Supervisors can discharge the County from continued efforts to collect funds owed to the County; and

 

WHEREAS, the Department of Parks requests that the Board of Supervisors authorize the abandonment of collection efforts and relief of accountability for collection of unpaid rent on County Lease No. 5022 with Coyote Point Corporation as the likelihood of collection does not warrant the expense involved with collection efforts; and

 

WHEREAS, the Board of Supervisors desires to terminate any further efforts in the collection of this account.

 

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the Board of Supervisors makes the finding that the likelihood of collection of delinquent account lease No. 5022 between Coyote Restaurant Corporation and the County of San Mateo does not warrant the expense involved to collect and discharges the Department of Parks from accountability for collection of this account.
