Resolution Approving the Final Map, Accepting the Dedication of Public Utility Easements and Authorizing Execution of Agreement for the Construction of
On-Site Improvements Associated with the Rathgar Estates Subdivision, Redwood City Area

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, the Director of Public Works has recommended that the map entitled “RATHGAR ESTATES (Tract No. S-934), SAN MATEO COUNTY, CALIFORNIA,” be approved; and

WHEREAS, the Director of Public Works has recommended that this Board accept the offer of dedication of Public Utility Easements as shown on said Final Map for the benefit of the public; and

WHEREAS, the Director of Public Works has recommended that an agreement be entered into with Rathgar Court, LLC, developer of the Rathgar Estates Subdivision at 1718 Edgewood Road, for construction of on-site improvements to serve the proposed lots in the subdivision; and

WHEREAS, performance of the required on-site improvement work has been secured by a Faithful Performance Bond in the amount of $440,000 and a Payment Security Bond in the amount of $220,000 to secure payment for labor and materials has been filed with the Director of Public Works; and

WHEREAS, security in the amount of $220,000 shall be filed with the Director of Public Works to guarantee and warranty the work for one year following the completion and acceptance of the on-site improvements; and

WHEREAS, an Inspection Deposit has been paid to the Department of Public Works to cover the actual costs incurred by the County for regular and final inspections of the subdivision improvements in accordance with the County of San Mateo Subdivision Regulations; and

WHEREAS, this Board has considered the agreement and the recommendation of the Director of Public Works; and

WHEREAS, this Board concurs in the recommendation of the Director of Public Works.

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that:

1.

Said Map is hereby approved; and

2.

The Clerk of the Board is directed to execute the appropriate certificate on the Final Map and to file the map for record; and

3.

The Public Utility Easements as shown on said map and offered for dedication to the public on said map are hereby accepted on behalf of the public, but the County accepts no responsibility for the maintenance of said easements by accepting said easements on behalf of the public.

4.

The Agreement by and between the County of San Mateo and Rathgar Court LLC is hereby approved, and the President and the Clerk of the Board of Supervisors be, and they are hereby, authorized to sign same for and on behalf of the County of San Mateo.
