RESOLUTION AUTHORIZING:

1.

THE SHERIFF TO TOW UNATTENDED VEHICLES PARKED ON CERTAIN COUNTY ROADWAYS PRIOR TO AND DURING THE NORTH FAIR OAKS COMMUNITY FESTIVAL, AUGUST 18 AND 19, 2007; AND

2.

AUTHORIZE CLOSURE OF CERTAIN COUNTY ROADS AT OR NEAR MIDDLEFIELD ROAD, REDWOOD CITY, TO ALL BUT LOCAL TRAFFIC FOR ONE DAY DURING THE NORTH FAIR OAKS COMMUNITY FESTIVAL.

 

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, on Sunday, August 19, 2007, the San Mateo County Sheriff’s Office will be hosting a community festival in the North Fair Oaks area, which is located on and near Middlefield Road, between First Avenue and Fifth Avenue, in the unincorporated area of San Mateo County; and

WHEREAS, the festival is expected to include a parade, live entertainment, vendor booths, and activities, and it is projected that it will be attended by approximately 30,000 people; and

WHEREAS, to safely accommodate all the activities planned for the North Fair Oaks Community Festival, the Sheriff’s Office and the California Highway Patrol have proposed to close off the following part of Middlefield Road and subsidiary roadways to motor vehicle traffic from 10:00 p.m. on August 18, 2007 until 11:59 p.m. on August 19, 2007:

Middlefield Road:

From First Avenue to Fifth Avenue

Second Avenue:

From 373 & 380 Second Avenue, East to Middlefield Road, and from 412 & 415 Second Avenue West to Middlefield Road

    Third Avenue:

From William Avenue East to Middlefield Road, and from 420 & 421 Third Avenue West to Middlefield Road

Fourth Avenue:

From 384 & 389 Fourth Avenue East to Middlefield Road, and from 420 & 421 Fourth Avenue West to Middlefield Road

    Fifth Avenue:

From 423 Fifth Avenue to Middlefield Road on the north side of the street; and

    WHEREAS, the Sheriff’s Office plans to post the necessary signs and to notify the business/residential community at least a week in advance so persons can make alternate arrangements for their vehicles, and so that drivers have plenty of advance notice of the County’s intention to tow; and

    WHEREAS, Streets & Highways Code § 942.5 provides that the board of supervisors may restrict the use of, or close, any county highway whenever the board considers such closing or restriction of use necessary for the protection of the public; and this Board has determined that the road closures set forth herein would protect the public during the North Fair Oaks Community Festival; and

WHEREAS, Vehicle Code §22651 provides that any peace officer who is engaged in enforcing parking laws and regulations may remove a vehicle whenever any vehicle is parked or left standing where local authorities, by resolution or ordinance, have prohibited parking and have authorized the removal of vehicles, provided that no vehicle may be removed unless signs are posted giving notice of the removal; and

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that from 10:00 p.m. on August 18, 2007 until 11:59 p.m. on August 19, 2007, during the preparations for and the duration of the North Fair Oaks Community Festival, the Sheriff is hereby authorized to remove or to have removed any and all vehicles that are unattended in the following areas:

Middlefield Road:

From First Avenue to Fifth Avenue

Second Avenue:

From 373 & 380 Second Avenue, East to Middlefield Road, and from 412 & 415 Second Avenue West to Middlefield Road

    Third Avenue:

From William Avenue East to Middlefield Road, and from 420 & 421 Third Avenue West to Middlefield Road

Fourth Avenue:

From 384 & 389 Fourth Avenue East to Middlefield Road, and from 420 & 421 Fourth Avenue West to Middlefield Road

    Fifth Avenue:

From 423 Fifth Avenue to Middlefield Road on the north side of the street; and

    BE IT FURTHER DETERMINED AND ORDERED THAT on the dates and times above mentioned, the San Mateo County Sheriff or the Sheriff’s designee is authorized to restrict the use of or close the streets mentioned above on the grounds it would enhance the protection of the public. Said closure may involve the installation of barriers to preclude all traffic except for local traffic, emergency vehicles, and those vehicles designated by the Sheriff or the Sheriff’s designee, which are clearly marked on the attached map.
