Revocable Storm Water Drainage Permit On Edgewood County Park Property with Dan and Nancy Cook

 

RECOMMENDATION

Adopt a resolution authorizing:

    1) The President of the Board of Supervisors to execute a Revocable Storm Water Drainage Permit on Edgewood County Park Property with Dan and Nancy Cook for a term of 50 years at an initial annual fee of $500.

    2) The County Manager, or designee, to execute any notices, consents, approvals, terminations, and documents in connection with the Permit.

Goals 7and 22: Maintain the public safety of all residents and visitors and allow the County and local governments to effectively communicate, collaborate and develop strategic approaches to issues affecting the entire County. The permit contributes to these goals by establishing a solution that benefits the County of San Mateo, the City of Woodside and the public.

 

BACKGROUND

Dan and Nancy Cook have submitted a proposal to the County to discharge storm water runoff from their property onto Edgewood County Park Property.

 
 
 

At the request of the Director of Parks and Recreation, the Real Property Services Division negotiated a permit with the Cooks to better control and manage the storm water drainage on their property,

DISCUSSION

The Permit presented for your consideration has the following provisions:

1. The permit is for a term of fifty (50) years, terminable by the County upon sixty (60) days written notice to Permittees.

2. The improvements are to be constructed and maintained at Permittees’ expense.

3. All improvements are to be constructed in accordance with approved plans and specifications.

4. There is an annual fee that begins at $500 and then increases $100 each ten-year period thereafter.

The Director of Parks and Recreation concurs in this recommendation.

County Counsel has approved the agreement as to form.

FISCAL IMPACT

Permit fees will be deposited into the Department of Parks fund.
