Agreement with the AIDS Community Research Consortium

 

RECOMMENDATION:

Adopt a Resolution:

1)

Authorizing the President of the Board to execute an Agreement with the AIDS Community Research Consortium (ACRC) in the amount of $296,778 to provide health education and a food services program for the period of March 1, 2007 to February 28, 2008; and

 

2)

Authorizing the Director of Health or the Director’s designee to execute contract amendments which modify the County’s maximum fiscal obligation by no more than $25,000 (in aggregate) and/or modify the contract term and/or services so long as the modified term or services is/are within the current or revised fiscal provisions.

 

VISION ALIGNMENT:

Goals 5 & 8: Residents have access to healthcare and preventive care; and help vulnerable people – the aged, disabled, mentally ill, at-risk youth and others – achieve a better quality of life.

BACKGROUND:

ACRC has been successfully providing health education and food services to HIV/AIDS clients since 1998. A Request for Proposals (RFP) for health education and food services for the three-year period of March 1, 2007 to February 28, 2010, was released in December 2006. ACRC was selected to provide these services. Contracts are completed on an annual basis due to uncertainty of funding. On February 6, 2007, your Board approved Resolution 068525, authorizing the Controller to continue payments on the previous Agreement with ACRC for the period of March 1, 2007 to June 30, 2007, which allowed continuation of services until funding notification was received. This contract was placed on a second continuing resolution on June 5, 2007, authorizing the Controller to continue payments through September 30, 2007 due to the uncertainty and lateness of the reauthorization of the Ryan White CARE Act (RW) funding by Congress.

 

DISCUSSION:

In July 2007 the California State Office of AIDS (COA) notified the County that they would make additional funds available to ensure that RW funded programs remain whole. This funding will allow the AIDS Program to continue the food program and health education and risk reduction services. These services have enabled numerous HIV/AIDS clients to obtain proper nutrition and maintain stable and healthier lifestyles that will assist them to stay healthy as long as possible.

The Agreement has been reviewed and approved by County Counsel and Risk Management. The Contractor has assured compliance with the County’s Contractor Employee Jury Service Ordinance, as well as all other contract provisions that are required by County ordinance and administrative memoranda, including but not limited to insurance, hold harmless, non-discrimination and equal benefits.

 

FISCAL IMPACT:

The term of the Agreement is March 1, 2007 through February 28, 2008. The maximum amount for the agreement is $296,778: $288,036 from COA and $8,742 from General Funds. The Net County Cost of $8,742 represents the 3% Cost of Living Adjustment approved by your Board for community-based organizations for FY 2006-07 and FY 2007-08. The FY 2006-07 Adopted Budget included funds in the amount of $76,884, and the tentatively Adopted FY 2007-08 Budget includes sufficient appropriations for the remaining $219,894.
