RECOMMENDATION:

Adopt a Resolution:
|
1.
|
Waiving the Request for Proposals (RFP) process for policy consultation services;
|
|
2.
|
Authorizing the President of the Board of Supervisors to execute an Agreement with Breathe California: Golden Gate Public Health Partnership to provide tobacco cessation services, advocacy for smoke-free events, and policy consultation services for the term of July 1, 2007 through June 30, 2008, in the amount of $210,000; and
|
|
3.
|
Authorizing the Director of the Health Department or the Director's designee to execute contract amendments which modify the County's maximum fiscal obligation by no more than $25,000 (in aggregate), and/or modify the contract term and/or services so long as the modified term or services is/are within the current or revised fiscal provisions.

BACKGROUND:
|
In October 2004 the Human Services Agency’s (HSA) Tobacco Prevention Program (TPP) conducted a Request for Proposals (RFP) process for tobacco education and cessation services. Breathe California: Golden Gate Public Health Partnership (Breathe CA) was selected to conduct youth tobacco cessation services. Educational outreach activities were conducted in local schools in order to recruit youth into the tobacco cessation classes. At the time, tobacco cessation services for adults were conducted by the Smokefree Start for Families (SFSF) Program within the Health Department.

In FY 2006-07 the Breathe CA youth cessation services contract was renewed. In October 2006 TPP was transferred from HSA to the Health Department. As First 5 funding for the SFSF Program was slated to end in June 2007, Breathe CA agreed to develop adult tobacco cessation services in addition to existing youth services during January-June 2007. In June 2007 Resolution 068751 was approved by your Board to allow Breathe CA to provide these additional services.

DISCUSSION:
|
Breathe CA has been selected to provide tobacco cessation and secondhand smoke prevention services based on an RFP issued in May 2007. In addition to other services provided, Breathe CA will work with at least three community partners to implement smoke-free policies in outdoor and/or community venues. An RFP waiver is requested for the policy consultation portion of the Agreement. Breathe CA is the only organization with the experience and capability to provide training and technical assistance with regard to tobacco prevention policies in San Mateo County.

County Counsel has reviewed and approved the Agreement and Resolution as to form, and Risk Management has approved the Contractor’s insurance coverage. The contractor has assured compliance with the County's Contractor Employee Jury Service Ordinance, as well as all other contract provisions that are required by County ordinance and administrative memoranda, including but not limited to insurance, hold harmless, non-discrimination and equal benefits.

FISCAL IMPACT:
|
The term of this Agreement is July 1, 2007 through June 30, 2008. The total obligation of $210,000 will be provided by Tobacco Master Settlement funds and has been included in the Public Health tentatively Adopted FY 2007-08 Budget. There is no Net County Cost.
