RESOLUTION AUTHORIZING: 1) WAIVING THE REQUEST FOR PROPOSALS (RFP) PROCESS FOR POLICY CONSULTATION SERVICES; 2) THE PRESIDENT OF THE BOARD OF SUPERVISORS TO EXECUTE AN AGREEMENT WITH BREATHE CALIFORNIA: GOLDEN GATE PUBLIC HEALTH PARTNERSHIP TO PROVIDE TOBACCO CESSATION SERVICES, ADVOCACY FOR SMOKE-FREE EVENTS, AND POLICY CONSULTATION SERVICES FOR THE TERM OF JULY 1, 2007, THROUGH JUNE 30, 2008, IN THE AMOUNT OF $210,000; AND 3) AUTHORIZING THE DIRECTOR OF THE HEALTH DEPARTMENT OR THE DIRECTOR'S DESIGNEE TO EXECUTE CONTRACT AMENDMENTS WHICH MODIFY THE COUNTY'S MAXIMUM FISCAL OBLIGATION BY NO MORE THAN $25,000 (IN AGGREGATE), AND/OR MODIFY THE CONTRACT TERM AND/OR SERVICES SO LONG AS THE MODIFIED TERM OR SERVICES IS/ARE WITHIN THE CURRENT OR REVISED FISCAL PROVISIONS

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, Breathe California: Golden Gate Public Health Partnership (Breathe California) successfully responded to a Request for Proposals in May 2007 and;

WHEREAS, Breathe California has a proven record of providing tobacco cessation services, advocacy for smoke-free community events, and policy consulting services; and

WHEREAS, the best interests of the County of San Mateo are served by a Waiver of the Request for Proposals for policy consultation services, in that Breathe California is the only organization with the expertise, experience and capability to address tobacco prevention policies in San Mateo County; and

WHEREAS, there has been presented to this Board of Supervisors for its consideration and acceptance an Agreement with Breathe California to provide tobacco cessation services, advocacy for smoke-free events and policy consultation services for the term of July 1, 2007 through June 30, 2008, for a total obligation of $210,000; and

WHEREAS, this Board has examined and approved this Agreement as to both form and content and desires to enter into same:

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the President of this Board of Supervisors is authorized to execute said Agreement for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest the President’s signature thereto.

BE IT FURTHER RESOLVED that the Request for Proposals process for policy consultation services is hereby waived.

BE IT FURTHER RESOLVED that the Director of the Health Department or the Director's designee is authorized to execute contract amendments which modify the County's maximum fiscal obligation by no more than $25,000 (in aggregate) and/or modify the contract term and/or services so long as the modified term or services is/are within the current or revised fiscal provisions.
