SUBJECT:

Sale of County owned unimproved real property in the City of Half Moon Bay for open space purposes (COP 1405, 1407, 1408)

 

RECOMMENDATION:

Adopt a resolution:

    A). Declaring certain County-owned unimproved real property in the City of Half Moon Bay as surplus to the needs of the County in order to facilitate the use of that property for open space purposes, and

    B). Authorizing the commencement of actions necessary to sell said real property, and

    C). Authorizing and directing the County Manager, or his designee to execute a Purchase and Sale Agreement and a Grant Deed subject to Deed Restrictions and to execute any and all other documents in connection with the sale.

Goal(s): Goal 20. Government decisions are based on careful consideration of future impact, rather than temporary relief or gain. The sale of surplus unimproved property contributes to this commitment as part of a long-range strategy to protect and preserve open space on the coast.

 

BACKGROUND:

A request was received by the County to sell a parcel of land in Half Moon Bay, APN: 065-142-100, a U-shaped parcel containing approximately 35,000 square feet, located on the northwest corner of Thone Avenue and Florence Avenue. The request came from the Half Moon Bay Open Space Trust (HOST), now Coastside Land Trust (CLT) and Steven Jurvetson, owner of the parcel that lies in the center of the subject parcel. The County acquired the property in the mid 1970’s from private property owners for the Midcoast Beaches Concept Plan project. This project has been abandoned and the County has no current or future improvements or projects planned for the parcel.

On July 31, 2006, pursuant to Government Code Section 54956.8, this Board met in open session to identify the negotiator, the property which the negotiations concern, and the person(s) with whom the negotiator may negotiate. The County Manager was directed to negotiate with CLT for the purchase of the County parcel and Mr. Jurvetson regarding a corresponding conservation easement over his adjacent parcel.

In order to ensure that the County property is sold for open space purposes, it will be encumbered with deed restrictions that limit the use of the property and with affirmative duties to restore the natural habitat on the parcel. The property will be sold subject to deed restrictions limiting the use of the property and a right of first offer in the event the property is offered for sale to another party. It is the County’s desire to see the property owned by Mr. Jurvetson transferred subject to similar conservation restrictions.

 

Real Property Services completed an internal appraisal based on the value of the parcel with the deed restrictions and affirmative obligations. The value of the parcel is significantly lower than $25,000, enabling the sale of the parcel directly to any purchaser pursuant to Government Code §25526.5. Due to the fact that the property is being sold for open space purposes, a notice of sale must be sent to various public agencies pursuant to Government Code § 54222. The County is required to wait sixty days for a response from agencies before proceeding with any sale.

 

The City of Half Moon Bay will be asked to make a determination that the proposed sale conforms with their General Plan.

 

County Counsel has reviewed the proposed agreement and resolution.

 
 

FISCAL IMPACT:

Declaring property surplus will have no fiscal impact. Revenue from the sale will be deposited in the General Fund.
