Amendment to the Agreement with Anthony Thekkek, dba Burlingame Hacienda

   

RECOMMENDATION

Adopt a Resolution authorizing the President of the Board to execute an Amendment to the Agreement with Anthony Thekkek, dba Burlingame Hacienda to provide board and care services, increasing the Agreement maximum by $38,175 to a new maximum of $190,065, with no change to the term.

This Agreement contributes to this commitment and goal by providing board and care services to clients of San Mateo County Mental Health Services.

BACKGROUND:

On December 14, 2004, your Board approved an Agreement with Anthony Thekkek, dba Burlingame Hacienda, to provide board and care services for difficult to place clients. The term of that Agreement was July 1, 2004 through June 30, 2007, and the maximum obligation was $151,890.

 

This contractor provides two levels of service, the Step Down Service Level and the Augmented Service Level. Clients at the Step Down Service Level are generally more independent and stable, requiring lower levels of supervision and less intensive services. The Augmented Service Level is for seriously mentally ill clients who require a higher level of supervision and services including more intensive mental health services, social skills training, and assistance with activities of daily living.

 

Under the B-1 Administrative Memorandum, the selection of providers of residential services for mental health clients is exempt from the Request for Proposal requirement.

 

DISCUSSION:

The bed usage rate in the first two years of the Agreement was higher than what was projected in the original Agreement. This Agreement is being amended to increase the contract maximum by $38,175 in order to pay costs associated with the increased usage. The term of the Agreement remains July 1, 2004 through June 30, 2007. The Amendment is effective July 1, 2006, and includes a 3% cost-of-living adjustment for FY 2006-07.

 

The Amendment to the Agreement has been reviewed and approved by County Counsel and Risk Management. New required contract language pertaining to the Employee Jury Service Ordinance is also being added to this amended Agreement. The contractor has assured compliance with the County's Contractor Employee Jury Service Ordinance, as well as all other contract provisions that are required by County ordinance and administrative memoranda, including but not limited to insurance, hold harmless, non-discrimination and equal benefits.

 

The Amendment was initially delayed due to contractor’s late return of the signed Amendment. It was further delayed due the late provision of insurance certificates and subsequent administrative delays in Mental Health.

 

Fiscal Impact

The Agreement maximum is being increased $38,175 from $151,890 to $190,065 for the three-year term. A total of $67,000 was included in the FY 2006-07 Adopted Budget for these services. Sales tax provided through realignment covered $59,630 of the cost. The remaining $7,370 was Net County Cost.
