AN ORDINANCE AMENDING
TITLE 3 – PUBLIC SAFETY, MORALS AND WELFARE, AND
TITLE 7– VEHICLES AND TRAFFIC
OF THE SAN MATEO COUNTY ORDINANCE CODE

 

The Board of Supervisors of the County of San Mateo, State of California, ORDAINS as follows:

 

SECTION 1. Section 3.96.010 of the San Mateo County Ordinance Code is hereby repealed, and Chapter 3.96, Highway Closures, is hereby deleted.

 

SECTION 2. Chapter 7.02, Highway Closures, is hereby added to Title 7 the San Mateo County Ordinance Code to read as follows:

 

Section 7.02.010 Highway Closures

The Director of Public Works may temporarily close County highways for parades, celebrations and other purposes for the protection of the public. In emergency situations the Director of Public Works may immediately restrict the use of, or close, any County highway whenever he considers such closing or restriction of use necessary:

 
 

(a)

For the protection of the public.

 
 

(b)

For the protection of the County highway from damage during storms.

 
 

(c)

During construction, improvement or maintenance operations thereon.

 

The Director of Public Works, or the Director’s designee, is authorized to prohibit parking on County highways that are closed pursuant to this section, and in that case shall post for a minimum of twenty-four (24) hours in advance of said closure signs giving notice that vehicles parked or left standing on those County highways will be removed.

 

The Sheriff, or the Sheriff’s designee, is authorized to remove or to cause the removal of vehicles parked or left standing on County highways that have been closed and posted pursuant to this section.

 

SECTION 3. Section 7.34.010 of the San Mateo County Ordinance Code is hereby amended to read as follows:

 

7.34.010 No Parking and Tow Away Zone.

No person shall park or leave standing any motor vehicle, whether attended or unattended, in any area declared by Resolution of the Board of Supervisors as a No Parking and Tow Away Zone, and where appropriate signs or markings are installed and maintained as provided in Chapter 7.28. The Director of Public Works shall cause said areas to be marked or signs erected notifying the public that parking is prohibited and that vehicles left parked in said areas will be towed at the owner’s expense.

 

In the event that any officer removes a vehicle that is parked in violation of this section, such officer shall give the notice provided for in Section 22852 et seq. of the Vehicle Code of the State of California, and the keeper of any garage in which any such vehicle is stored may have a lien thereon for his compensation for towage and for caring for and keeping safe such vehicle and may satisfy such lien upon compliance with and under the conditions stated in Section 22851 of the Vehicle Code.

 

SECTION 4. Section 7.34.020 of the San Mateo County Ordinance Code is hereby repealed.

 

SECTION 5. This Ordinance shall be effective thirty (30) days from the passage date thereof.
