RESOLUTION DECLARING CERTAIN COUNTY-OWNED UNIMPROVED REAL PROPERTY IN THE CITY OF HALF MOON BAY AS SURPLUS TO THE NEEDS OF THE COUNTY IN ORDER TO FACILITATE THE USE OF

THAT PROPERTY FOR OPEN SPACE; AUTHORIZING THE COMMENCEMENT OF ACTIONS NECESSARY TO SELL SAID SURPLUS PROPERTY; AND AUTHORIZING THE EXECUTION OF A PURCHASE AND SALE AGREEMENT AND ALL OTHER DOCUMENTS IN CONNECTION WITH THE SALE.

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, on October 21, 1977 the County of San Mateo acquired certain unimproved real property as recorded in 7636 O.R. 383 records of the County of San Mateo, California, on June 30, 1978 the County of San Mateo acquired certain unimproved real property as recorded in 7758 O.R. 1411 records of the County of San Mateo, California, and on September 1, 1978 the County of San Mateo acquired certain unimproved real property as recorded in 7776 O.R. 1230 records of the County of San Mateo, California, and said real property is generally described as Lots 4-9, 10-12, and 1, 2, 3, 15 & 16 of Ola Vista Beach Block 10 in the City of Half Moon Bay (the “Real Property”); and

 

WHEREAS, the herein described unimproved Real Property is not required for County purposes and it appears to be in the best interest of the County to sell said Real Property subject to certain conservation deed restrictions; and

 

WHEREAS, it is the desire and intent of this Board to facilitate and ensure the preservation of this Real Property as open space in the County of San Mateo and Section 25526.5 of the Government Code of the State of California provides for the sale of surplus property with an estimated value not exceeding $25,000 on the terms and conditions set by the Board of Supervisors; and

 

WHEREAS, the Real Property will be sold with deed restrictions and the value of the Real Property as appraised was determined to be significantly less than $25,000; and

 

WHEREAS, a notice of sale will be sent to various public agencies pursuant to Government Code Section 54222 (b); and

WHEREAS, there has been presented to this Board of Supervisors for its consideration and acceptance, a Purchase and Sale Agreement concerning the Real Property (the “Purchase and Sale Agreement”), reference to which is hereby made for further particulars, and the Board of Supervisors has examined and approved the same as to form and content and desires to enter into the same.

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED AS FOLLOWS:

    1. That it is the opinion of this Board that the Real Property herein described and located in the County of San Mateo is surplus to the needs of the County and not needed for public use by the County of San Mateo.

    2. That the County Manager, or his designee, is hereby ordered and authorized to commence the process to dispose of the Real Property for open space purposes.

    3. That the County Manager, or his designee, upon compliance with Government Code section 52222 (b), is hereby authorized and directed to execute said Purchase and Sale Agreement for and on behalf of the County of San Mateo, and to execute all other documents necessary to finalize the sale of the Real Property.
