    ADOPT A RESOLUTION AUTHORIZING THE COUNTY ELECTIONS OFFICIAL TO RENDER SPECIFIED ELECTION SERVICES TO LOCAL ELECTIVE DISTRICTS, IN CONJUNCTION WITH THE CONSOLIDATED DISTRICT ELECTION TO BE HELD ON TUESDAY, NOVEMBER 6, 2007, INCLUDING: BELMONT-REDWOOD SHORES SCHOOL DISTRICT, JEFFERSON ELEMENTARY SCHOOL DISTRICT, MILLBRAE SCHOOL DISTRICT, PORTOLA VALLEY ELEMENTARY SCHOOL DISTRICT, SAN BRUNO PARK SCHOOL DISTRICT, SAN CARLOS SCHOOL DISTRICT, SAN MATEO UNION HIGH SCHOOL DISTRICT, SAN MATEO-FOSTER CITY SCHOOL DISTRICT, BROADMOOR POLICE PROTECTION DISTRICT, COASTSIDE COUNTY WATER DISTRICT, HALF MOON BAY FIRE PROTECTION DISTRICT, LOS TRANCOS COUNTY WATER DISTRICT, MENLO PARK FIRE PROTECTION DISTRICT, MIDCOAST COMMUNITY COUNCIL, MONTARA WATER AND SANITARY DISTRICT, POINT MONTARA FIRE DISTRICT, CITY OF BELMONT, CITY OF BRISBANE, CITY OF BURLINGAME, CITY OF FOSTER CITY, CITY OF MILLBRAE, CITY OF REDWOOD CITY, CITY OF SAN BRUNO, CITY OF SAN CARLOS, CITY OF SAN MATEO, CITY OF SOUTH SAN FRANCISCO, AND TOWN OF WOODSIDE.

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, California Elections Code section 10002 permits any city or district, by resolution, to request the authorization of the county board of supervisor that the county elections official shall render specified election services to the city or district in a consolidated district election as provided by Elections Code section 10403, and

 

WHEREAS, Elections Code section 10403.5 requires the county board of supervisors to grant the authorization unless the county elections official determines that the election cannot be handled; and

 

WHEREAS, absent other arrangements, the city or district shall reimburse the County in full for the services performed by the county elections official in accordance with the Uniform District Election Law (Elections Code §§ 10500-10556); and

 

WHEREAS, the Belmont-Redwood Shores School District, Jefferson Elementary School District, Millbrae School District, Portola Valley Elementary School District, San Bruno Park School District, San Carlos School District, San Mateo Union High School District, San Mateo-Foster City School District are required to hold regularly scheduled governing board elections, and the named districts have notified the county elections official of the number of seats to be elected and the relevant policies for breaking a tie vote and conflict of interest filings for candidates, and more candidates filed for election in the named districts than there are seats available; and

 

WHEREAS, pursuant to state law, the Broadmoor Police Protection District, Coastside County Water District, Half Moon Bay Fire Protection District, Los Trancos County Water District, Menlo Park Fire Protection District, Midcoast Community Council, Montara Water and Sanitary District, Point Montara Fire District have notified the county elections official of the number of seats to be elected, the conflict of interest requirements for candidates, and the boundaries of the district, and more candidates filed for election in the named districts than there are seats available; and

 

WHEREAS, pursuant to state law, the governing body of the Burlingame Elementary School District adopted Resolution No. 2007/08-1 giving notice of holding an election on Tuesday, November 6, 2007, for the purpose of submitting to district voters a bond measure, and requesting election services as provided by Elections Code section 10002; and

 

WHEREAS, pursuant to state law, the board of directors of the Colma Fire Protection District adopted Resolution No. 2007/2008-01 giving notice of holding an election on Tuesday, November 6, 2007, for the purpose of submitting to district voters a special tax measure, and requesting election services as provided by Elections Code section 10002; and

 

WHEREAS, pursuant to state law, the board of directors of the Menlo Park Fire Protection District adopted Resolution No. 1171 giving notice of holding an election on Tuesday, November 6, 2007, for the purpose of submitting to district voters a fiscal measure, and requesting election services as provided by Elections Code section 10002; and

 

WHEREAS, pursuant to state law, the city council of the City of Belmont adopted Resolution No. 9889 giving notice of holding an election on Tuesday, November 6, 2007, for the purpose of electing two city council members and one city clerk and one city treasurer, each for a four-year term, and requesting election services as provided by Elections Code section 10002, and a Service Agreement therefor has been executed with the county elections official; and

 

WHEREAS, pursuant to state law, the city council of the City of Brisbane adopted Resolution No. 2007-20 giving notice of holding an election on Tuesday, November 6, 2007, for the purpose of electing two city council members for a term of four years and requesting election services as provided by Elections Code section 10002, and a Service Agreement therefor has been executed with the county elections official; and

 

WHEREAS, pursuant to state law, the city council of the City of Burlingame adopted Resolution No. 25-2007 giving notice of holding an election on Tuesday, November 6, 2007, for the purpose of electing two city council members for a four-year term, and requesting election services as provided by Elections Code section 10002, and a Service Agreement therefor has been executed with the county elections official; and

 

WHEREAS, pursuant to state law, the city council of the City of Foster City adopted Resolution No. 2007-43 giving notice of holding an election on Tuesday, November 6, 2007, for the purpose of electing three city council members for a four-year term, and requesting election services as provided by Elections Code section 10002, and a Service Agreement therefor has been executed with the county elections official; and

 

WHEREAS, pursuant to state law, the city council of the City of Millbrae adopted Resolution No. 07-34, Resolution No. 07-35, and Resolution No. 07-36 giving notice of holding an election on Tuesday, November 6, 2007, for the purpose of electing three city council member for a four-year term, and requesting election services as provided by Elections Code section 10002, and a Service Agreement therefor has been executed with the county elections official; and

 

WHEREAS, pursuant to state law, the city council of the City of Redwood City adopted Resolution No. 14791 and Resolution No. 14792 giving notice of holding an election on Tuesday, November 6, 2007, for the purpose of electing four city council members for a four-year term, and requesting election services as provided by Elections Code section 10002, and a Service Agreement therefor has been executed with the county elections official; and

 

WHEREAS, pursuant to state law, the city council of the City of San Bruno adopted Resolution No. 2007-70 giving notice of holding an election on Tuesday, November 6, 2007, for the purpose of electing two city council members for a four-year term and one mayor for a two-year term, and requesting election services as provided by Elections Code section 10002, and a Service Agreement therefor has been executed with the county elections official; and

 

WHEREAS, pursuant to state law, the city council of the City of San Carlos adopted Resolution No. 2007-030 giving notice of holding an election on Tuesday, November 6, 2007, for the purpose of electing two city council members, one city clerk, and one treasurer, each for a four-year term, and requesting election services as provided by Elections Code section 10002, and a Service Agreement therefor has been executed with the county elections official; and

 

WHEREAS, pursuant to state law, the city council of the City of San Mateo adopted Resolution No. 68-2007 giving notice of holding an election on Tuesday, November 6, 2007, for the purpose of electing two city council members for a four year term, and requesting election services as provided by Elections Code section 10002, and a Service Agreement therefor has been executed with the county elections official; and

 

WHEREAS, pursuant to state law, the city council of the City of South San Francisco adopted Resolution No. 53-2007 giving notice of holding an election on Tuesday, November 6, 2007, for the purpose of electing two city council members for a four year term, and one city clerk, for a two year term and requesting election services as provided by Elections Code section 10002, and a Service Agreement therefor has been executed with the county elections official; and

 

WHEREAS, pursuant to state law, the city council of the Town of Woodside adopted Resolution No. 2007-6630 and 2007-6631 giving notice of holding an election on Tuesday, November 6, 2007, for the purpose of electing four city council members, for a four-year term, and requesting election services as provided by Elections Code section 10002, and a Service Agreement therefor has been executed with the county elections official; and

 

WHEREAS, pursuant to state law, the city council of the City of Redwood City adopted Resolution No. 14795 and Resolution No. 14796 giving notice of holding an election on Tuesday, November 6, 2007, for the purpose of submitting to city voters a charter amendment and a utility users’ tax, and requesting election services as provided by Elections Code section 10002, and a Service Agreement therefor has been executed with the county elections official; and

 

WHEREAS, pursuant to state law, the city council of the City of San Bruno adopted Resolution No. 2007-69 giving notice of holding an election on Tuesday, November 6, 2007, for the purpose of submitting to city voters a general tax, and requesting election services as provided by Elections Code section 10002, and a Service Agreement therefor has been executed with the county elections official; and

 

WHEREAS, pursuant to state law, the city council of the City of South San Francisco adopted Resolution No. 77-2007 and Resolution No. 78-2007 giving notice of holding an election on Tuesday, November 6, 2007, for the purpose of submitting to city voters an ordinance and a business license tax, and requesting election services as provided by Elections Code section 10002, and a Service Agreement therefor has been executed with the county elections official; and

 

WHEREAS, in consideration of services and supplies to be provided by the county elections official, the County will be fully reimbursed by the aforesaid cities and districts;

 

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the county elections official shall be, and hereby is, authorized to render specified election services to the aforesaid cities and districts for the November 6, 2007 Uniform District Election.
