Annexation of Property to the Fair Oaks Sewer Maintenance District -
Lands of Ceschin (300 Ridgeway Road, APN 069-361-160) Woodside Area

 

Recommendation

Acting as the governing board of the Fair Oaks Sewer Maintenance District (District), adopt a resolution setting a time and place (November 27, 2007 – Board Chambers, 400 County Center) for a public hearing to consider the proposed annexation of the Lands of Ceschin to the Fair Oaks Sewer Maintenance District.

Your Board authorizing a public hearing to consider the proposed annexation can result in providing effective sanitary sewer service to a parcel in a suburban area that would otherwise use an “on-site” method to handle wastewater, which could have an impact on neighboring residents.

 

Background

Previous Board Action

Entered into an agreement (Agreement) with the Town of Woodside (Town) dated
April 2, 1968, for the provision of sewage transmission and disposal through District facilities, of wastewater collected by the District for properties within the corporate limits of Woodside and the Town’s Redwood Creek Main Trunk and Glens Collection System Assessment District, once the properties are annexed to the District.

 

History

The Town/District Agreement as described above requires properties within the Town that are proposed to be served by the District to be annexed to the District, and also requires the Town to approve said annexations into the District. The Town executed Resolution 2007-6645 on July 24, 2007 (attached), consenting to the proposed annexation of this property. A public hearing to consider an annexation to the District is required pursuant to Section 5820 et seq. of the Streets and Highways Code.

 

Discussion

Lino P. and Margaret D. Ceschin are the current owners of the property within the Town of Woodside at 300 Ridgeway Road, which is also identified as Assessor’s Parcel Number 069-361-160. They have requested that their property be annexed to the District in order to receive sewer service.

 

We have determined that the property can be served through the facilities of the District, and are recommending that a public hearing be set for your regular meeting of November 27, 2007, at 9:30 a.m., to consider the proposed annexation.

 

A resolution has been approved as to form by County Counsel, and we will post and publish the required notices subject to your Board adopting the proposed resolution.

The property owner will be subject to the annual sewer service charge levied by the District, currently $400 per year, and will also be required to construct and pay for the sewer lateral that is necessary to bring sewer service to this property, if the annexation is approved and sewer service provided.

 

There is no impact on the General Fund.
