SUBJECT:

Emergency for San Mateo County due Cosco Buscan Oil Spill of November 8,2007

 

RECOMMENDATION:

Adopt a resolution declaring the continued existence of a local emergency in San Mateo County resulting from the November 8, 2007 oil spill and ratify the proclamation of the local emergency pursuant to section 8558(c) of the Government Code and San Mateo County Ordinance Code Section 2.46.060

BACKGROUND:

On November 8, 2007, a significant oil spill occurred when the container ship COSCO BUSAN struck the fender surrounding a footing of the western span of the Bay Bridge in the San Francisco Bay. This incident caused approximately 53,000 gallons of medium fuel-grade oil to spill into the San Francisco Bay and continues to spread, causing damage in City and County of San Francisco, as well as the counties of Alameda, Contra Costa, Marin, San Mateo, Solano and Sonoma.

 

The San Mateo County OES Emergency Command Center was activated on November 9, 2007 to respond to the Oil Spill and on November 12, 2007 Oil was found on Pacifica Beaches.

 
 
 
 

The Governor declared a State of Emergency for the six (6) Bay Area counties on November 9, 2007 and the Emergency Services Act also requires local jurisdictions to adopt a proclamation in order to be eligible for California Disaster Assistance Act (CDAA) funds. On November 20, 2007, the County Manager as the Director of Emergency Services for the County of San Mateo proclaimed the existence or threatened existence of a local emergency. The spill continues to threaten marine life and the environment in San Mateo County, including marine mammals, birds and fish populations and creates conditions of extreme peril to the safety of persons and property in the area. The spill has and will cause an undetermined economic impact to local businesses.

 

FISCAL IMPACT:

A declaration of a State of Emergency will facilitate the reimbursement of expenses of cities, town, special districts and the county for resources expended in the response to the Oil Spill by the owners of the Cosco Buscan. Should all costs not be covered by the owners of the Cosco Buscan then cites, towns, special districts and county will be eligible to seek assistance under the California Disaster Assistance Act (CDAA).
