SUBJECT:

Annexation of Property to the Fair Oaks Sewer Maintenance District - Lands of Ceschin (300 Ridgeway Road, APN 069-361-160) Woodside Area

 

RECOMMENDATION:

Acting as the governing board of the Fair Oaks Sewer Maintenance District and after conducting the public hearing, adopt a resolution:

 

1.

Ordering the annexation of the Lands of Ceschin to the Fair Oaks Sewer Maintenance District (District).

 

2.

Directing the Director of Public Works to transmit a copy of the resolution ordering annexation to the Town of Woodside, the County Assessor and the State Board of Equalization.

Your Board authorizing the proposed annexation can result in the District providing sanitary sewer service to a parcel in a suburban area that would otherwise use an “on-site” method to handle wastewater, which could have an impact on neighboring residents.

 

BACKGROUND:

 

PREVIOUS BOARD ACTION

1.

Entered into an Agreement with the Town of Woodside (Town) dated April 2, 1968, for the provision of sewage transmission and disposal through District facilities, of wastewater collected by the District for properties within the corporate limits of Woodside and the Town’s Redwood Creek Main Trunk and Glens Collection System Assessment District, once the properties are annexed to the District.

Set 9:30 a.m. on Tuesday, November 27, 2007, in your Chambers, as the time and place of a public hearing to consider the annexation of the Lands of Ceschin to the District.

 

HISTORY

Lino P. and Margaret D. Ceschin are the current owners of the property, which is eligible for annexation to the District and which is located at 300 Ridgeway Road. The property is also identified as Assessor’s Parcel Number 069-361-160. They have requested that their property be annexed to the District in order to receive sewer service.

 

The Agreement requires properties within the Town that will be served by the District, to be annexed to the District.

 

A public hearing to consider an annexation to the District is required pursuant to Section 5820 et. seq. of the Streets and Highways Code.

 

DISCUSSION:

The public hearing to consider the proposed annexation has been properly noticed and the appropriate description prepared.

 

A resolution has been approved as to form by County Counsel and the Town has consented to the annexation by adopting their Resolution 2007-6645.

 

The District is able to provide sewer service to the property. Therefore, we are recommending that the annexation be approved

The property owner will be subject to the annual sewer service charge levied by the District, currently $400 per year, and will also be required to construct and pay for the sewer lateral that is necessary to bring sewer service to this property, if the annexation is approved and sewer service provided.

 

There is no impact to the General Fund.
