RESOLUTION APPROVING THE EXECUTION OF A 10-YEAR OPEN SPACE EASEMENT AGREEMENT BETWEEN THE COUNTY OF SAN MATEO AND THE MIDPENINSULA REGIONAL OPEN SPACE DISTRICT FOR 23 ACRES OF THE DRISCOLL RANCH PROPERTY IN THE HARRINGTON CREEK WATERSHED, ACCEPTING THE EASEMENT AND DIRECTING THAT IT AND A CERTIFICATE OF ACCEPTANCE BE RECORDED WITH THE COUNTY RECORDER, AND AUTHORIZING THE DIRECTOR OF THE DEPARTMENT OF PARKS TO PAY, UPON RECEIPT OF STATE FUNDS, $114,365 OF 2000 STATE PARK BOND ACT FUNDS TO MIDPENINSULA REGIONAL OPEN SPACE DISTRICT

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, the Midpeninsula Regional Open Space District purchased the Driscoll Ranch property in December 2006 as an addition to the La Honda Creek Open Space Preserve; and

 

WHEREAS, County Parks wishes to enhance the parks and recreation, agricultural preservation and open space purpose including public trail opportunities within the County’s coast side by contributing $114,365 of 2000 State Bond Act funding towards the Midpeninsula Regional Open Space District’s acquisition of Driscoll Ranch; and

 

WHEREAS, County Parks and the District approached State Parks, the administrator of the grants programs, to determine the best way for the State Bond Act funds to be transferred for this use; and

 

WHEREAS, State Parks advised County Parks to adopt an Open Space Easement Agreement that would be included with the other site control and land tenure requirements for the required grant completion submittal; and

 

WHEREAS, the Easement Property will be retained in its scenic, agricultural and open space condition, the proposed 10-Year Open Space Easement Agreement (Agreement) restricts the use of the Easement Property to allow only activities involving agricultural grazing, low-intensity public recreational use, open space, resources management, natural habitat and environmental protection and other consistent uses; and

 

WHEREAS, the term of the Agreement will run for a period of ten years and will expire on the tenth anniversary of the date it was signed by the County; and

 

WHEREAS, the County agrees to prepare a quitclaim upon expiration of the Agreement for recordation, quitclaiming all of the County’s rights and interests in the Easement; and

 

WHEREAS, the Board of Supervisors has considered the 10-Year Open Space Easement Agreement and approved it as to form and content and desires to enter into and accept the Agreement.

 

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the President of the Board of Supervisors be, and is hereby authorized and directed to execute said Agreement and the Certificate of Acceptance for and on behalf of the County of San Mateo; that the Clerk of this Board shall attest the President’s signatures thereto and be and is hereby directed to record said Agreement and Certificate of Acceptance with the County Recorder; and the Director of the Department of Parks is authorized to pay, upon receipt of State funds, $114,365 of 2000 State Park Bond Act funds to Midpeninsula Regional Open Space District.
