RESOLUTION SETTING A TIME AND PLACE OF A PUBLIC HEARING TO CONSIDER A FACILITY GROUND LEASE AND AGREEMENT WITH NORTHSTAR POWER LTD. TO DESIGN, ENGINEER, CONSTRUCT, OPERATE, AND MAINTAIN A COGENERATION SYSTEM AT THE SAN MATEO COUNTY HEALTH CAMPUS AND TO PURCHASE ENERGY PRODUCED BY THE SYSTEM

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that
|
|
WHEREAS, this Board of Supervisors has approved projects that reduce energy costs at County facilities including Maguire Correctional Facility and the Youth Services Center; and
|
|
WHEREAS, the California Energy Commission conducted a study in 2006 and determined that cogeneration at the Health Campus would be cost effective; and
|
|
WHEREAS, Northstar Power proposes to design, engineer, construct, operate, and maintain a cogeneration system at the San Mateo County Health Campus and sell the energy produced to the County at rates ten percent (10%) below rates the County would otherwise pay to its regular utility providers; and
|
|
WHEREAS, Section 4217.12q. of the California Government Code provides that a public agency may enter into an energy service contract and any necessarily related facility ground lease on terms that its governing body determines are in the best interests of the public agency if the decision is made at a regularly scheduled public hearing, public notice of which is given at least two weeks in advance and the board finds that the cost for energy under the contract will be less than the anticipated marginal cost of energy that would otherwise have been consumed; and

WHEREAS, this Board wishes to consider such an agreement:

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that

this Board will conduct a public hearing during its regular scheduled meeting on December 18, 2007, at 9:15 a.m. in the Board's Chambers in the Hall of Justice and Records at 400 County Center, Redwood City, California, to consider an agreement with Northstar Power Ltd. to design, engineer, construct, operate, and maintain a cogeneration system at the San Mateo County Health Campus and to purchase energy produced by the system.

the Director of Public Works shall cause notice of said public hearing to be published once in the Independent Newspaper Group, a newspaper of general circulation.
