SUBJECT:

Annexation of Property to the Oak Knoll Sewer Maintenance District - Lands of Withrington (19 Don Court, APN 058-040-190) – Redwood City (Oak Knoll) Area

 

RECOMMENDATION:

Acting as the governing board of the Oak Knoll Sewer Maintenance District (District), adopt a resolution setting a time and place (January 8, 2008, 9:15 a.m. – Board Chambers, 400 County Center) for a public hearing to consider the proposed annexation of the Lands of Withrington to the Oak Knoll Sewer Maintenance District.

Your Board authorizing a public hearing to consider the proposed annexation, can result in providing effective sanitary sewer service to a parcel in a suburban area that would otherwise use an “on-site” method to handle wastewater, which could have an impact on neighboring residents.

 

BACKGROUND:

 

PREVIOUS BOARD ACTION:

Entered into an agreement (Agreement) with the City of Redwood City (City) dated August 23, 1983, which provides for the transmission and disposal through City facilities, of wastewater collected in the District.

 

HISTORY:

The City/District Agreement as described above requires properties that are proposed to be served by the District to be annexed to the District, and also requires the City to approve said annexations into the District. The City executed Resolution 14812 on October 8, 2007 (attached), consenting to the proposed annexation of this property. A public hearing to consider an annexation to the District is required pursuant to Section 4860 et seq. of the Health & Safety Code.

 

DISCUSSION:

Peter and Elaine Withrington are the current owners of the property at 19 Don Court, which is also identified as Assessor’s Parcel Number 058-040-190. They have requested that their property be annexed to the District in order to receive sewer service.

 

We have determined that the property can be served through the facilities of the District, and are recommending that a public hearing be set for your regular meeting of January 8, 2008, at 9:15 a.m., to consider the proposed annexation.

 

A resolution has been approved as to form by County Counsel, and we will post and publish the required notices subject to your Board adopting the proposed resolution.

 

FISCAL IMPACT:

The property owner has paid or will pay all required fees for the parcel as follows:

The property owner will be subject to the annual sewer service charge levied by the District, currently $500 per year, and will also be required to construct and pay for the sewer lateral that is necessary to bring sewer service to this property, if the annexation is approved and sewer service provided.

 

There is no impact on the General Fund.
