SUBJECT:

Authorization to Render Specified Election Services in Conjunction with the February 5, 2008 Presidential Primary

 

RECOMMENDATION:

Adopt a resolution authorizing the Chief Elections Officer to render specified election services to the Ravenswood City School District, San Mateo-Foster City Elementary School District, Sequoia Union High School District, and the County of San Mateo, in conjunction with the presidential primary election to be held on Tuesday, February 5, 2008

This consolidation of local and statewide elections scheduled to be held within the county on the same day will provide uniformity and efficiency of operations under the direction of the Chief Elections Officer, so that voters can express their opinions on important issues and candidates for public office.

 

BACKGROUND:

California Elections Code sections 100002 provides permits the governing body of a local district or city to request, by resolution, that the this Board permit the Chief Elections Officer to render specified services relating to the conduct of an election. The Code also provides for reimbursement to the county of all related costs. Section 10002 further provides that the requesting district or city, absent other satisfactory arrangements, shall reimburse the County in full for the services performed, upon presentation of a bill to the city or district.

 

DISCUSSION:

Resolutions were timely filed by the above named governing bodies, and the Chief Elections Officer has prepared service agreements whereunder the County will be reimbursed for the costs of the services and supplies to be rendered. The Board has requested election services for a ballot measure involving a special tax to the voters of County Service Area No. 1.

 

On November 26, 2007, the Chief Elections Officer submitted to this Board a memorandum and a proposed form of resolution to authorize the Chief Elections Officer to provide specified election services to the above named districts as well as the City of Half Moon Bay. On December 5, the Chief Elections Officer received notice from the City of Half Moon Bay that its City Council had, at its regular meeting on December 4, approved Resolution 53-07 to withdraw its request for specified election services concerning a ballot measure proposing a special tax. Accordingly, the Chief Elections Officer has revised the form of resolution proposed for adoption by this Board, and has revised this memorandum to advise the Board of this change.

 

The Chief Elections Officer has determined that there is no impediment to conducting the elections as requested, and recommends this Board’s authorization thereof.

 

County Counsel has reviewed and approved this resolution.

 

FISCAL IMPACT:

As provided by state law and written service agreements, the Ravenswood City School District, the San Mateo-Foster City Elementary School District, and the Sequoia Union High School District will reimburse the County for the cost of election services and supplies. The County will be responsible for all other costs, including the election for County Service Area No. 1 and the statewide contests.

 

Senate Bill 113, which established the new and separate February presidential primary (Chap. 2, Statutes of 2007, 3/15/07) stated the intent of the Legislature to fully reimburse counties for related costs added by the new primary “in an expeditious manner upon certification of those costs.” However, no appropriation is included in this year’s state budget, and the Legislature has indicated it will consider an appropriation during next year’s budget process when actual election costs will be known.
