RESOLUTION AUTHORIZING THE PRESIDENT OF THE BOARD OF SUPERVISORS TO EXECUTE, ON BEHALF OF THE COUNTY, AN AGREEMENT, DEED AND EXCHANGE OF EASEMENTS (“AGREEMENT”) AFFECTING APN 047-330-010, IN UNINCORPORATED EL GRANADA, AND AUTHORIZING THE COUNTY MANAGER OR HIS DESIGNEE TO EXECUTE NOTICES, CONSENTS, APPROVALS, TERMINATIONS, DEEDS, ESCROW INSTRUCTIONS, CERTIFICATES OF ACCEPTANCE AND DOCUMENTS REQUIRED UNDER THE AGREEMENT UNDER THE TERMS SET FORTH THEREIN. RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, there has been presented to this Board of Supervisors for its consideration and acceptance, an Agreement, Deed and Exchange of Easements (“Agreement”) dated September 1, 2007, between the COUNTY OF SAN MATEO and the COASTSIDE COUNTY WATER DISTRICT; and

WHEREAS, District holds an easement over a portion of APN 047-330-010, which parcel is owned by County, and said easement contains a water line that is to be replaced by District as part of its “Phase 3B El Granada Water Pipeline Replacement Project”; and

WHEREAS, County desires to grant a new easement to allow District to install the replacement water line, on the condition that District quitclaims the existing easement to County upon completion of the Project, as set forth in the agreement; and

WHEREAS, this Board has been presented with the Agreement and has examined and approved same as to both form and content and desires to enter into same.

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the President of this Board of Supervisors be, and is hereby, authorized and directed to execute said Agreement, Deed and Exchange of Easements for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest the President’s signature thereto; and

IT IS FURTHER DETERMINED AND ORDERED that the County Manager or his designee is hereby authorized to execute notices, consents, approvals, terminations, deeds, escrow instructions certificates of acceptance and documents required under the Agreement under the terms set forth therein.
