BOARD OF SUPERVISORS, COUNTY OF SAN MATEO, STATE OF CALIFORNIA

RESOLUTION AUTHORIZING EXECUTION OF A CONTRACT WITH SOIL ENGINEERING CONSTRUCTION, INC., FOR THE DESIGN OF SLOPE STABILIZATION IMPROVEMENTS WITHIN THE LANDSLIDE ON SCENIC DRIVE IN THE LA HONDA AREA
(PROJECT NO. R2E01, F-36 [256])

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, land movement in 2005 has displaced and caused the closure of a portion of Scenic Drive in the La Honda area, a County maintained road; and

WHEREAS, the Department of Public Works has caused the land movement area to be studied by competent and licensed geotechnical engineers; and

WHEREAS, the studies have concluded that additional County roads are at significant risk if no formal mitigation measures are undertaken; and

WHEREAS, this Board of Supervisors did, on October 30, 2007, adopt Resolution No. 069071, which resolution effectively authorized the Department of Public Works to proceed with preparations for the construction of recommended slope stabilization improvements such that the work could begin at the earliest opportunity during the next construction season, and to continue to communicate and work with the La Honda community in the consideration of cooperative funding arrangements and other potential third party funding sources..

WHEREAS, the Department of Public Works has determined that in order to be prepared to begin the construction of the slope stabilization improvements in a timely manner, it is necessary to immediately enter into a Plan Development Agreement with Soil Engineering Construction, Inc..

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED as follows:

1.

The President of this Board of Supervisors is hereby authorized and directed to execute, for and on behalf of the County of San Mateo, said Plan Development Agreement with Soil Engineering Construction, Inc., for the preparation of design plans for the slope stabilization improvements in the La Honda area, based on a design-build approach, and to receive and approve the Faithful Performance Surety Bond and the Labor and Material Surety Bond required to be posted by the said Contractor with the County of San Mateo in connection therewith;

2.

That the Department of Public Works is authorized to continue activities as set forth in Resolution No. 069071.

3.

That, aggregate payments to Soil Engineering Construction, Inc. pursuant to the Plan Development Agreement shall not exceed the sum of One Hundred Thousand and No/100 Dollars ($100,000.00) without this Board's approval.

4.

That the Clerk of the Board of Supervisors, County of San Mateo, shall be, and is hereby, authorized and directed to attest the signature of the President of this Board of Supervisors to said Plan Development Agreement. .

5.

That the Board of Supervisors hereby waives the Request for Proposal process for this Agreement.
